Although headquartered in Switzerland, the world’s largest food group Nestlé has been present in France since 1868. Today the French arm of the Nestlé business earns more than €4bn with a workforce of over 13,000 in 22 industrial sites, divided into European and local centres of excellence as well as five research centres. Comprised of multiple divisions that serve the company’s French operations and subsidiaries, notable members of the legal function include Sophie Germain, general counsel for Nestlé Waters and head of tax Laurence Corcos. Other important figures in the team are Joffrey Favretto, head of business law and Nicolas Gacia, head of the legal and social affairs division. An innovative development the team has assisted on can be seen through its work concerning Herta, Nestlé’s specialist seller of deli meats. In 2015, the subsidiary signed a partnership with Syproporcs in the first “swap contract” of its kind in the pork industry in France and Europe, aimed at experimenting a new commercial relationship between a producer group and Herta. Following successful results, the team helped Herta enter into two new swap contracts with Cirhyo cooperatives and Porc Armor Evolution. Through Herta, Nestlé is further transforming France’s charcuterie market with the launch of the first sodium nitrite-free cooked ham as part of an on-going drive for fewer additives in its products. The legal team were again responsible in navigating the complex regulatory environment to bring the product to market in 2017. With the parent company exploring the possibility of selling its 23% stake in French cosmetics group L’Oreal, the legal team will be relied upon again to deliver smooth results after the outgoing chairman recently stated ‘anything you do on the equity would have to be done very prudently’.
