Fabiola Valenzuela Viera

Head of the legal counsel unit | Universidad Catolica Boliviana - Sede Santa Cruz

How do you approach managing legal aspects during periods of instability or crises, and how does your legal strategy align with the broader business strategy to ensure the organisation’s resilience?

During instability or crises, we focus on proactive risk assessment and clear communication; therefore, the legal unit establishes preventive measures, strengthens compliance frameworks, and ensures that decision-making remains consistent with both regulatory requirements and the university’s ethical standards. Anticipating risks and preparing contingency strategies, helps us reduce exposure and maintain institutional integrity.

This approach aligns closely with the university’s broader strategy of promoting academic excellence, innovation, and social commitment. While leadership ensures continuity in teaching, research, and community engagement, the legal department provides a solid framework that enables resilience. In this way, legal safeguards and strategic goals reinforce each other to maintain trust and long-term stability.

What are the main cases or transactions that you have been involved in recently?

Recently, the legal department has managed a variety of matters. These include:

Negotiating and reviewing agreements with partner institutions to ensure they are structured as collaborations rather than leases.
Supporting litigation processes, including judicial proceedings that safeguard the university’s interests.
Advising on labor-related issues affecting academic and administrative staff.
Overseeing disciplinary proceedings and ensuring compliance with higher education regulations.
These activities require balancing technical expertise with sensitivity to the university’s educational and social mission.

What measures has your company taken to embed sustainability practices into its core business operations, and how does the role of the general counsel/in-house counsel teams contribute to driving and ensuring sustainable practices within the company?

The university has adopted sustainability practices that emphasise environmental and social responsibility, this includes integrating sustainability into teaching and research, implementing responsible procurement processes, and developing programs that engage students in community-oriented projects.

The legal unit ensures these initiatives are supported by adequate policies and compliant contracts, integrating sustainability clauses into agreements, monitoring regulatory requirements, and providing advice that reinforces the university’s commitment to responsible and sustainable growth.

What do you see as the major legal challenges for businesses in Bolivia over the next five years, and how are you preparing to address them?

Challenges include adapting to labor law reforms, ensuring compliance with evolving higher education regulations, and responding to heightened demands for transparency and governance. Additionally, the rise of digital transformation brings new issues such as data protection and cybersecurity, which require robust legal frameworks.

To prepare, the legal unit emphasises continuous training, active monitoring of legislative developments, and preventive strategies. Our goal is to anticipate risks and strengthen institutional practices so that the university not only complies with the law but also leads by example in Bolivia’s higher education sector.
