Daniel Kanter serves as assistant general counsel and chief counsel for global antitrust at IATA, a trade association of the world’s airlines consisting of 290 airlines and representing 117 countries. In addition to ensuring antitrust compliance for IATA and the aviation industry, he works to set the strategic direction of competition law policy for aviation globally. This involves overseeing certain areas where competition needs more support, such as when airlines are on the receiving end of anticompetitive conduct. He also reviews strategic options on an industry-wide basis, in order to make the industry more competitive and lower costs. Amongst some of the cases he has managed, Kanter has been the lead counsel for IATA’s efforts as a formal complainant in the European Commission’s investigation into monopolistic practices in the aircraft MRO market. ‘This is an area of deep concern for our members and accounts for approximately US$64bn per year’, says Kanter. He previously worked in various positions in leading competition teams in Brussels and Washington, DC. He was also the lead counsel for IATA’s intervention as a third party in the Australian Competition and Consumer Commission (ACCC) v Flight Center case in Australia. Earlier this year Kanter spoke as part of a panel that dissected the ACCC’s decision, which challenged much of the conventional perception around the legal treatment of principal agents under Australian competition law.
