What are the most significant cases or transactions that your legal team has recently been involved in?

ISA Interchile’s legal and regulatory team participated in an international arbitration case at ICSID against the Republic of Chile. We also participated in the bidding process that led to the award to the Yallique consortium of the HVDC Kimal – Lo Aguirre high-voltage line, the largest to be built in Chile.

Additionally, the legal and regulatory team participated in the successful issuance of a green bond for $1.2m carried out in 2021 and in the recent award of the transmission project “Nueva S/E Seccionadora Nueva Lagunas y Nueva Línea 2×500 kV Nueva Lagunas – Kimal “.

How do you suggest in-house lawyers build strong relationships with business partners?

Building stronger relationships with our business partners is done by understanding the business need for legal and regulatory support to meet its goals and objectives, which ultimately, will also be part of ours.

If our area is not capable of understanding the need, the legal and regulatory response or opinion will not be adequate, it will be abstract and therefore it will affect the company’s strategy and objectives.

Support must be framed within a harmonious working relationship and compliance with the required deadlines.

What are some of the main legislative or regulatory changes that have impacted you?

A total change in our Chilean Political Constitution is currently being discussed. This process requires the legal and regulatory area to make a permanent evaluation of the discussion and the constituent work, since eventually there may be effects on the regulatory model of the business.

Likewise, the government has promoted several labour, tax, ESG and criminal law initiatives, which directly impact the business model and even the company’s own executives, which implies that each process must be supervised every time, with more intensity by the legal and regulatory area, and in collaboration with the compliance area.
