J. Mauricio Méndez Sarti is an in-house counsel at ADIUM Central America & the Caribbean, where he serves as a Legal Business Partner and plays a key role in legal decision-making, supporting the company’s operations across the region. His practice focuses on data protection, civil, labour, corporate and commercial law, with particular emphasis on complex cross-border contracting, distribution strategies, and regulatory-driven environments within the pharmaceutical industry.

He leads the structuring, negotiation, and management of key commercial agreements with suppliers and distributors, while driving regional and multi-jurisdictional legal strategies in close coordination with the Head of Legal. Mauricio also has supervisory responsibilities over a junior lawyer, contributing to the development, alignment, and execution of the legal function.

He is actively involved in strengthening internal legal frameworks and compliance processes to enhance operational efficiency, mitigate risk, and support business growth.

Mauricio holds a law degree from Universidad de San Carlos de Guatemala and is currently pursuing a Master’s degree in Corporate Law at Universidad Rafael Landívar.

What do you think are the most important attributes for a modern in-house counsel to possess?

Get to know your business. A modern in-house counsel must combine strong legal judgment with a deep understanding of the business. Beyond technical expertise, the ability to act as a strategic partner is essential. Adaptability is also critical, particularly in multi-jurisdictional and highly regulated environments, where legal frameworks, business models, and risk exposure constantly evolve. In this context, clear communication and the ability to translate complex legal concepts into practical, business-oriented advice become key differentiators.

What is a cause, business or otherwise, that you are passionate about? Why is this?

A cause I am particularly passionate about is the proper balance between freedom of contract and regulatory intervention in commercial relationships. Through my professional and academic work, I have focused on how excessive or inflexible regulation, particularly in distribution and commercial agreements through the region, can unintentionally distort market dynamics and limit the autonomy of independent parties.

I am especially interested in promoting legal frameworks that respect party autonomy while still safeguarding legitimate public interests. In practice, this translates into structuring agreements that are both compliant and commercially efficient, allowing businesses to operate with certainty while preserving flexibility in their relationships.

This interest stems from both my academic research and my day-to-day experience as in-house counsel in a highly regulated, multi-jurisdictional environment, where striking the right balance between legal protection and business agility is not only a theoretical concern, but a constant, practical challenge.
