In Latin America, where political and economic volatility is common, a standard legal approach is insufficient. Drawing from direct experience in challenging jurisdictions like Bolivia, my strategy is inherently proactive and adaptive. We integrate deep legal foresight with aggressive risk mitigation, anticipating shifts in populist or resource-nationalist policies. The legal function doesn’t just react; it shapes the crisis response, turning regulatory challenges into competitive advantages by ensuring operational continuity and safeguarding assets. This absolute alignment with business strategy is critical for building organizational resilience and securing our license to operate in turbulent energy and mining sectors.

What are the main cases or transactions that you have been involved in recently?

My recent work involves pioneering transactions in frontier markets. I provided the legal framework for one of the first international transport gas deals through Bolivia, enabling gas flow from Argentina to Brazil using the Bolivian pipeline system. Furthermore, I have played a pivotal role in structuring innovative contractual schemes for lithium investments in Bolivia. Given the limited specific legal framework, this involved creating the legal architecture for EDL plant investments in lithium carbonate production. These projects demonstrate my focus on navigating regulatory voids to unlock strategic value in Latin America’s complex energy and mining sectors.

What do you see as the major legal challenges for businesses in Bolivia over the next five years, and how are you preparing to address them?

The major challenges include navigating the evolving regulatory framework for strategic sectors like lithium, mining, and oil and gas, which are influenced by complex community relations, and stricter environmental standards. The upcoming presidential elections add a layer of uncertainty, as potential shifts in fiscal, economic and investment policies could alter the contractual landscape. Furthermore, the national economic crisis influences project execution, increasing risks of supply chain instability and budget overruns. We prepare through proactive regulatory monitoring. My focus is on integrating legal advice with technical expertise, ensuring client proposals incorporate sustainable practices and robust community engagement from the outset. This positions our clients as resilient, responsible partners, mitigating legal and operational risks in a dynamic environment.
