In times of crisis, it is essential to adopt a conservative approach to the fulfilment of legal obligations and regulatory provisions. The implementation of a clear and structured compliance programme provides precise guidelines that help steer decision-making in the face of various challenges.

Making difficult decisions and maintaining firmness in their execution is indispensable in complex scenarios. Crises do not arise overnight; they are often preceded by signals from the market and the political environment. It is therefore crucial to maintain constant vigilance over these indicators to anticipate events, take timely action and mitigate potential adverse effects.

What are the main cases or transactions that you have been involved in recently?

Two key aspects of our day-to-day work have gained particular relevance over the past year.

First, judicial debt collection has become one of the most critical functions within the legal department due to its direct impact on the company’s annual financial performance. In recent years, we have focused on reducing the volume of cases in the judicial portfolio and have successfully decreased it to around 30% of its original size since we began addressing this challenge.

Second, we have played an active role in adapting various elements of Finning’s business operations to Bolivia’s current economic landscape, particularly the constraints caused by limited access to U.S. dollars. This has involved reviewing and restructuring contractual arrangements, proposing alternative payment solutions and ensuring compliance with local financial regulations. My contribution has centred on minimising legal and operational risks, supporting strategic decision-making and helping maintain business continuity in a complex and evolving financial environment.

What measures has your company taken to embed sustainability practices into its core business operations, and how does the role of the general counsel contribute to driving and ensuring sustainable practices within the company???

Finning has taken comprehensive measures to embed sustainability into its core operations by integrating ESG considerations into strategic planning, risk management and execution. The company has established a dedicated global sustainability director and a cross-functional global sustainability committee, both reporting to the chief development officer, who oversees the integration of sustainability into corporate strategy. These structures ensure accountability and alignment across all business units.

The legal department, including the general counsel and in-house counsel teams, plays a pivotal role in this framework by managing sustainability-related legal and reputational risks, ensuring compliance with evolving regulations and supporting the development and implementation of policies such as the Sustainability Policy, Code of Conduct and Supplier Code of Conduct. Their involvement is critical in safeguarding ethical standards, overseeing human rights due diligence and contributing to governance practices that reinforce Finning’s commitment to sustainable growth and stakeholder trust.
