How do you approach managing legal aspects during periods of instability or crises, and how does your legal strategy align with the broader business strategy to ensure the organisation’s resilience?
In my role as National Legal Affairs Manager at BancoSol, I have led the legal department through periods of regulatory change and economic uncertainty. My approach is rooted in proactive legal risk assessment, agile decision-making, and alignment with the bank’s strategic goals—particularly its commitment to financial inclusion and digital transformation. By fostering a culture of legal foresight and responsiveness, we ensure that legal strategies support business continuity and resilience. I emphasise empowering my team to act as strategic partners, not just legal advisors, enabling the organisation to navigate challenges with confidence and legal integrity.
What are the main cases or transactions that you have been involved in recently?
Recently, I have overseen legal structuring for digital financial products aimed at underserved populations, ensuring compliance with evolving regulations. I also led negotiations and legal due diligence for strategic partnerships with international development institutions, including frameworks aligned with ESG standards. My team has successfully managed complex administrative and judicial proceedings, particularly in judicial and extrajudicial collections and regulatory matters, reinforcing our institution’s legal standing and operational agility.
What measures has your company taken to embed sustainability practices into its core business operations, and how does the role of the general counsel/in house counsel teams contribute to driving and ensuring sustainable practices within the company?
BancoSol has embedded sustainability into its core operations by aligning with the UN Sustainable Development Goals, particularly those related to financial inclusion and gender equality. As General Counsel, I play a key role in ensuring that our legal frameworks support these commitments. This includes advising on sustainable finance instruments, overseeing compliance with environmental and social risk assessments, and promoting governance practices that reflect our institutional values. Legal counsel is instrumental in translating sustainability goals into enforceable policies and contractual obligations.
What do you see as the major legal challenges for businesses in Bolivia over the next five years, and how are you preparing to address them?
Bolivia faces significant legal challenges in the coming years, including adapting to digital transformation, evolving data protection laws, and increasing regulatory scrutiny in financial services. The legal profession must prepare for greater integration of technology in legal processes, enhanced compliance frameworks, and cross-border legal harmonisation. At BancoSol, we are investing in legal tech tools, continuous training, and strategic partnerships to stay ahead of these trends and ensure our legal department remains a driver of innovation and compliance.
