Although the legal team at Minsur is a compact function of five professionals, it has an impressively deep level of knowledge by being highly specialised in legal matters within the mining industry. Also adept at regulation and compliance matters in the sector, the team is deeply committed to establishing and maintaining a risk preventative culture within Minsur – the main corporate company of the mining division of Grupo Breca and one of the biggest business conglomerates in Peru. Under the management of legal and regulatory compliance manager Eduardo Paseta Spihlmann, the legal team is in charge of providing legal and regulatory support to the company as well as to mitigate all compliance matters that arise. César Palacios is the legal compliance chief, predominantly in charge of all the mining industries regulatory matters of Compañia Minera Raura, a fellow company of Minsur, which oversees the polymetallic mining unit called “Raura” and Minsur’s tin smelter. Senior lawyer Rodrigo Echevarria is in charge of all the mining industry regulatory matters of the “San Rafael” tin mining unit and the “Pucamarca” gold mining unit, and is also in charge of the legal management of the mining properties concessions of Grupo Breca’s mining division and of the mining regulatory matters of various exploration projects. Africa Morante, is an environmental law specialist who works closely with César Palacios, providing legal advice in mining industry regulatory matters to Raura’s mining unit. Karen Collantes serves as the team’s compliance specialist, responsible for executing the recently approved compliance program for the company, the execution and maintenance of the prevention model, the management of the risks register of criminal compliance and ethics culture of the company. ‘The company strongly believes that in order to be sustainable in time it has to follow and comply [with] the highest standards in the world mining industry, and for that reason it is conducting bigger and harder efforts to establish a preventive culture and compliance in the broad sense of the word’, says Spihlmann. In line with these efforts, the company recently created a new position of legal and regulatory compliance manager and promoted Spihlmann to lead the area. Since August 2018, the team is no longer part of Minsur´s corporate legal department, but belongs to a separate area reporting to Minsur´s corporate affairs and sustainability direction. ‘This new responsibility has given us a more comprehensive view of our role in Minsur and Grupo Breca’s mining division to assure sustainability in time and a world-class status in the mining industry’, explains Spihlmann. The legal team has had relevant participation in the development and execution of projects such as the Mina Justa copper project, in charge of Marcobre, the majority shareholder, Project B2 tailings retreatment, and the sustainability of mining units such as Ruara and Pucamarca. ‘In addition, we have important responsibility in reducing legal and regulatory contingencies for the company and the implementation of the prevention model and the risk register of criminal compliance’, says Spihlmann. The legal team continues to promote and maintain a broad preventive culture within the company in order to ensure its sustainability and avoid legal and regulatory contingencies, whilst also creating value for the shareholders and for the country. ‘We believe that a preventive and ethical culture is key to achieve a world-class company status, and that the “how” is equally important as the “what”. For these reasons, we are conscious and aware that our area plays a relevant and strategic role inside the company’, says Spihlmann.
