Headquartered in Lima, LATAM Airlines – Perú was established in 1998 as a subsidiary of LATAM Airlines Group. The legal department that supports its Peruvian operations is made up of nine lawyers and is led by corporate affairs, legal and compliance director Antonio Olórtegui as well as two heads of area within litigation, regulatory and aeronautical affairs. ‘The work in legal during the last years has become very dynamic. Fortunately, we are a team composed of nine lawyers, who provide excellent support with experience and passion to the areas of operation and commercial development, which makes us a great team’, says Olórtegui. This work environment has been fundamental to achieve the objectives and growth that the department has subsequently had. The last two years have been especially successful for the legal team, achieving a number of significant transactions and big processes which have gone on to be recognised not only by judicial or administrative authorities but according to Olórtegui, also by ‘public opinion in Peru’. The compliance counsel team has promoted and led the preparation of the “Code of Ethics and Transparency of the Civil Aviation Operations of Peru”, a document that has been prepared with the guidance of DGAC (aeronautical authority of Peru) and is based on internal regulations and politics of compliance. The document establishes the commitment of the signatory airlines to self-regulate and act in accordance with the requirements of good corporate faith, while adopting a criterion of ethics and transparency in its relations with authorities, public officials, passengers and competitors. In the regulatory arena, the legal team has participated in various regulation and rate setting projects in order to reduce the expenses incurred by airlines. ‘After different pricing procedures, it was possible to reduce the airworthiness tariffs by up to 26% charged by CORPAC (the public airport authority), and, for the first time in the history of the concession, a reduction in airport rates was achieved at the international airport Jorge Chávez of Lima through the productivity factor of the concession contract. For this, legal, and economic reports and a powerful media campaign was presented with the purpose of publicising the high rates that were being charged’, explains Olórtegui. The legal team has successfully managed to become true allies of all internal clients of the business. ‘We have become partners and leaders in the negotiation with new commercial allies or contractual management’, says Olórtegui.
