Described as a group of ‘young, dynamic, brave, smart, ambitious and well prepared’ professionals by nominators, the Spanish legal and compliance department serving the world leading pharmaceutical company Menarini Group is a provider of practical and strategic advice to all divisions of the organisation. The team contains six members, and is led by Ana Bayó Busta who first joined Menarini six years ago after amassing experience in private practice as well as an industrial company from the Puig Group. In addition to Bayó, other team members are based in separate legal and compliance areas, with Víctor Buqueras and Federico Vargiu dealing with all licensing in and licensing out agreements for Spain and Latin America, services related agreements, support to the Latin America affiliates, IP, corporate, regulatory and support to all the Spanish departments in legal related matters and advice. Meanwhile, in the compliance area, Maria Sanchez Puy works on data privacy and deontological compliance (including EFPIA Transparency) and agreements with healthcare professionals and organisations, as well as R&D agreements. Mercedes Alemany is ‘key in the legal and compliance department of Spain and Latin America as our support and assistant’ according to Bayó. The team has made a difference to the company’s bottom line; having a key impact in a number of projects that include, as Bayó explains, the ‘re-structuring and consolidating of a corporate governance structure within the Spain and Latin America hub of Menarini, including the assumption of the secretary position of the board of directors’. The team has also created compliance programmes for these companies, and has negotiated and advised on all ‘negotiating and advising on relevant licensing in and out agreements for Spain and Latin America’. The team has also recently defended ‘the right to data exclusivity of a medicine’ and has been busy implementing a ‘global data privacy governance model for the companies in Spain and Latin America in line with GDPR’. The team’s culture is described by Bayó as ‘proactive, quick, transversal, diplomatic and efficient’, and thanks to a combination of this culture and the achievements above, it has become a trusted advisor and accrued the reputation of being a business-oriented team which not only advises but also is able to find innovative solutions to complex matters. The legal and compliance members are professionals who have all of the personal qualities to become leaders in the industry.
