Legal counsel contracts | Comcel - Claro Colombia

What are the most significant cases or transactions that your legal team has recently been involved in?

Claro is the largest telecommunications operator in Colombia. Its most significant cases have been negotiating legal, technical and economic conditions with clients such as Oracle, Amazon, and the Ministry of Communications of Colombia, with amounts exceeding $100m in the last six months. The contracts were developed for connectivity, data centre services, private cloud, and apps. Additionally, I have created customised contract models where different technological tools converge, allowing customers to access business solutions for logistics management, digital sales channels, and billing from anywhere in the world.

I believe my experience in recognising the most suitable and efficient tools in the negotiation of contracts and the support given to support business management is one of my key traits.

What do you predict will be the biggest change in the legal market over the next few years?

The greatest legal challenge will be establishing innovation as an element of greatest relevance. The nature of the contracts must be associated with technological services. The latter is not an exclusive or excluding obligation. As it contains an integral solution for a client, the concept, in this case, will be a contractual object aimed at providing services to customers and improving their experience.

The contract is how a lawyer interprets the new reality of business and takes them to fully enforceable binding commitments. Failure consists of the non-correspondence between the form and reality of a given concept. The challenge will be to improve the legal experience by simplifying contractual models based on a convergent object.

As we enter the next decade, what skills will an in-house lawyer need to succeed in the modern in-house industry?

Companies and clients need lawyers to be able to adapt to the changing environments generated by technological innovation, so lawyers must be attentive in interpreting laws and regulations according to these variations to prevent their positions from becoming anachronistic.

With the development of digital ecosystems, it is becoming increasingly necessary for a lawyer to generate convergent obligations between different tools, facilitating the integration of applications that allow comprehensive services with flexible structures.
