How do you approach managing legal aspects during periods of instability or crises, and how does your legal strategy align with the broader business strategy to ensure the organisation’s resilience?
In a period of instability or crises within an organisation, the management of legal aspects must be addressed according to the level of importance and significance they have for the company, with serenity and composure, because in such moments it is imperative to prioritise so as not to neglect situations that could further complicate the situation. The legal strategy must always be in line with the interests of the company, without losing sight of the principles, values, and ethics that forge the organisation, despite the instability it is experiencing.
What are the major cases or transactions you have been involved in recently?
My main role within the organisation is to develop legal strategies for portfolio recovery, anticipate contingencies, and take the necessary actions to combat and eliminate risks, such as the termination of government contracts and the application of conventional penalties. The adequate study of the case, timely intervention, prudent argumentation, adequate justification, and sound negotiation with one of the State Secretariats resulted in the non-termination of a contract for the 2021 fiscal year and the application of conventional penalties for non-delivery of assets for reasons not attributable to the company being reasonable, safeguarding the company’s interests and maintaining a cordial relationship with that Secretariat.
What measures has your company taken to embed sustainability practices into its core business operations,and how does the role of the general counsel contribute to driving and ensuring sustainable practices within the company?
Measures such as treating water at the facilities and reusing it for various activities, such as irrigation and sanitation, have been important in generating savings within the organisation. Legal advice for adopting, promoting, and ensuring the use of sustainable practices within the organisation is essential and plays a key role in compliance with legal regulations.
Drinking water points were implemented, reusable plastic containers were provided, and reusable tableware and cutlery are used in the cafeteria.
We have green areas to improve the urban environment, people’s physical and mental health, and sustainable development.
How do you prioritise diversity and inclusion within your legal department, and what initiatives have you implemented to foster a more inclusive and equitable work environment?
Diversity and inclusion are definitely a necessity and priority within the legal department, as they must be guided by the organisation’s principles. Personnel selection processes are open and free of bias to ensure equality and take into account the knowledge and professionalism with which they perform. Therefore, we are pleased to know that within our ranks we have professionals belonging to the LGBT+ community, who actively participate in decision-making and are responsible for leading high-impact projects.
In addition, there are also people with disabilities within the company, and in my area, professional ethics, respect, and zero tolerance for discrimination are always promoted.
