VP, legal compliance and corporate affairs | Nestlé
How do you approach managing legal aspects during periods of instability or crises, and how does your legal strategy align with the broader business strategy to ensure the organisation’s resilience?
As General Counsel for Nestlé Mexico—Nestlé’s fourth-largest market globally—my
approach to legal strategy during periods of instability is centered on agility,
institutional collaboration, and alignment with our business purpose. It is always
grounded in doing what is legal and what is right in full compliance with our Corporate
Business Principles and Code of Conduct
Business Principles and Code of Conduct.
Legal resilience is not only about anticipating and mitigating risk, but about enabling
continuity, trust, and protecting people (employees, consumers and society) and our
pets and our planet. In recent crises, such as supply chain disruptions, our legal team
implemented dual-track strategies: pursuing legal protections while engaging relevant
stakeholders, including society and authorities—to foster resolution. These actions
ensured uninterrupted operations and reinforced Nestlé’s reputation for ethical
leadership and responsible business conduct.
Our legal strategy is embedded within Nestlé’s global crisis management framework,
which emphasises transparency, stakeholder trust, and governance excellence. We
work with a multidisciplinary approach, collaborating closely with other functions to
ensure that legal decisions protect people and support both commercial resilience
and social impact.
What are the major cases or transactions you have been involved in recently?
One of the most significant cases I am currently leading involves trademark litigation
that has raised serious concerns within our organisation about judicial impartiality in
Mexico. Despite presenting solid legal arguments, procedural consistency, and even
prior favorable decisions, we have observed signs of favoritism and nepotism that
challenge the principles of fairness and transparency that should govern all dispute
resolution.
The case remains ongoing, and we continue to litigate it. We view this matter as an
opportunity to reaffirm our commitment to Mexico and our confidence in its
institutions. We believe the current Judicial Reform represents a vital step toward
strengthening the rule of law and eliminating corruption, nepotism, and privilege.
Through this case, we aim to contribute constructively to a legal system that is
impartial, transparent, and aligned with the principles of justice and legal certainty.
Fostering Diversity, Equity, and Inclusion
In May 2024, Nestlé Mexico joined companies like Herdez, Modelo, Coca-Cola, Orbia,
FedEx, KPMG, and Novo Nordisk to sign the DEI Commitment for the Legal Sector.
This initiative, launched at Nestlé offices with founders and members of the GC
Network, urges general counsels to prioritise law firms that promote diversity across
age, gender, orientation, background, and ethnicity. We are committed to building a
more inclusive legal ecosystem—and in this, general counsels can make a meaningful
Difference.
Embedding Sustainability Through Legal Leadership
Sustainability is central to Nestlé Mexico’s operations, and Legal plays a critical role in
embedding it into the company’s governance and societal impact frameworks. As
General Counsel, I ensure that sustainability is not only a strategic priority but also a
legally sound and ethically enforced commitment. We lead the enforcement of
human rights policies, whistleblower mechanisms, regulatory compliance, and
uphold ethical standards across our value chain and operations. Legal is a driver of
responsible business conduct and long-term societal value.
