What are the most significant cases, projects or transactions that you and/or your legal team have recently been involved in?

At M.C. Inversiones (MCI), our main business relates to investment in a joint venture with our partner in the mining industry. The legal team at MCI works closely with the business team at various stages of each joint venture, with support from external counsel.

MCI’s mission is to lead the mineral resources industry together with our stakeholders, creating and sharing sustainable value as the best partner. Based on this mission, it is important that MCI continues to be chosen by our business partners. To achieve this, integrity is an essential value.

To maintain and enhance this integrity, and with the full alignment of our management team, our legal team plays a pivotal role not only in organising and updating internal control matters in response to regulatory requirements, but also in fostering a corporate culture that promotes integrity through cross-functional collaboration.

How do you approach managing legal aspects during periods of instability or crisis to ensure the organisation’s resilience?

It is important to access information directly through efficient communication with our management team and colleagues. Once we obtain the necessary information, we can analyse it and consider the next steps appropriately, taking into account all possible issues. To respond swiftly to a crisis, communication during normal times is essential. Building a relationship of trust on a regular basis is a powerful tool in responding to a crisis.

Have you had any experiences during your career as a lawyer that stand out as particularly unique or interesting?</strong?

As a member of an in-house legal team, I have experienced various types of transactions in different regions throughout my career. I am currently working as Head of MCI’s Legal Division, supporting and advising our business teams on the investment side of the mining industry.

What I find interesting is that, even if the industry or the country or region differs, the important elements are ultimately very similar. On the other hand, in the mining industry, which I am currently involved in, I feel that the wide range of stakeholders requires a broader and more careful response, as well as greater knowledge and experience.

Based on your experiences in the past year, are there any trends in the legal or business world that you are keeping an eye on that you think other in-house lawyers should be mindful of?

It is important not only to understand and interpret laws and regulations themselves, but also to prepare for the future by identifying trends in legislation at the drafting stage and by analysing the impact on the relevant legal system in light of the global geopolitical situation. It is also important to understand the situation not only at the global level but also at the local level, and to consider what preparations should be made in connection with a project.
