How do you approach managing legal aspects during periods of instability or crises, and how does your legal strategy align with the broader business strategy to ensure the organisation’s resilience?
Managing legal aspects during periods of instability or crises requires a strategic and proactive approach, identifying potential legal risks associated with the crisis and develop a comprehensive crisis management plan that outlines roles, responsibilities, and procedures for addressing the legal issues.
Regarding legal strategy alignment with business strategy, I always foster collaboration with other departments, such as operations, finance, business development and project management, building strong relationship and communication to ensure that all teams are aligned with the overall business strategy.
Also, I adopt strategic legal risk management that focus on prevention rather than response to legal challenges, taking proactive legal counselling and aligning both business priorities and legal requirements, promoting a culture of compliance throughout the organisation.
In sum, the legal department needs to act as a business partner, aligning legal strategies with business goals, enhancing collaboration across departments, and ensuring that legal considerations are embedded in everyday business activities. This partnership contributes to the organisation’s overall results and resilience.
What are the major cases or transactions you have been involved in recently?
I led legal team that worked on auction preparation for Brazil’s largest-ever electricity transmission line auction, corresponding to construction, operation and maintenance of the 800 kV Ultra-High Voltage Direct Current Transmission System, interconnecting the Graça Aranha (MA) and Silvânia (GO) substations. The transmission line route extends for 1,468km, passing through the states of Maranhão (MA), Tocantins (TO) and Goiás (GO).
The legal work includes pre-bid documents preparation, drafting and negotiation of contracts with suppliers and signing concession agreements. Since then, the legal team has been supporting all legal aspects of the project implementation.
What emerging technologies do you see as having the most significant impact on the legal profession in the near future, and how do you stay updated on these developments?
AI became a reality in the legal field, transforming the routine of legal professionals, redefining the way lawyers deal with lawsuits and data.
The integration of AI into legal work enhances efficiency and reduces costs. The ones that I consider that have more impact in legal works are virtual assistants that: (i) quickly analyse large volumes of legal documents, identifying relevant information, reducing the time lawyers spend on manual reviews; (ii) conduct legal research more efficiently by searching through vast databases of case law, statutes, and regulations; (iii) assist in drafting, reviewing, and managing contracts, and; (iv) assist in jurimetrics, by analysing historical case data, helping lawyers’ strategies based on likely scenarios.
