How do you approach managing legal aspects during periods of instability or crises, and how does your legal strategy align with the broader business strategy to ensure the organisation’s resilience?
I usually say that moments of instability and crises are conducive to further provoking our creativity, resilience, and courage. And it is in this way that I like to handle not only the legal aspects but also any strategic business discussions during these periods. Understanding the challenges posed in these moments and the impact on the business is, from my perspective, crucial to identify the opportunities that will arise from them. This, combined with working in partnership and closely with the organisation, will enable the legal department to be better prepared to present innovative and secure solutions, taking advantage of the opportunities that difficult moments bring to achieve the organisation’s common goals.
What are the major cases or transactions you have been involved in recently?
Practically alongside my start in this new role, decisions from the Supreme Federal Court concerning the judicialisation of medications were published, bringing significant changes to the topic. Understanding the impact of these changes not only for one industry but for the sector was already a great challenge. Next, understanding the fronts we could act upon and realising that this issue would not be resolved solely through legal actions was extremely important for us to establish an operating strategy, combining efforts from legal, access, communication, and institutional relations areas in a systemic and integrated manner, aiming to contribute to society for a better solution and adaptation to the new rules set forth by the aforementioned decision published by the Supreme Court.
Specifically regarding our legal action, we sought alternatives to participate in discussions as Amicus Curiae, preparing to map subsequent judicial decisions in order to generate data for a factual analysis of the change generated by these decisions, and specifically, we are working on legal technical documents and to define better legal/advocacy strategy so that we can bring to the attention of the authorities evidence of the impact of these decisions as well as constructive contributions so that the possibility of adjustments that will benefit society as a whole can be analysed.
What emerging technologies do you see as having the most significant impact on the legal profession in the near future, and how do you stay updated on these developments?
Artificial intelligence (AI) is likely the most recent and impactful technology in our routines, and it seems that its data analysis capabilities will continue to surprise us in the future. Today, not using these tools means giving up relevant information for carrying out the most routine activities as well as the more elaborate ones. I strive to stay updated on the topic through reading scientific articles, participating in discussions at events, always seeking to understand the benefits that AI can bring to the execution of my work as a manager and executor, while also being mindful of the limits and the importance of analysis based on lived experiences in order to further complement the performance in the legal department of a company.
