What are the most significant cases, projects or transactions that you and/or your legal team have recently been involved in?

During the second half of 2024, we participated in the negotiation and signing of an insurance distribution agreement with one of the largest retailers in the country for the exclusive distribution of non-life insurance through its distribution channels for the next 10 years. Personally, I actively participated in the structuring of the business and the negotiation of the alliance contracts together with the external advisors we hired for these purposes (Claro & Cia).

How do you approach managing legal aspects during periods of instability or crisis to ensure the organisation’s resilience? 

Chile is going through a stage of regulatory changes that are increasingly frequent and with impacts that can be substantial on the business if not adequately addressed. In this sense, the role of the legal manager is not only to be attentive to these changes and inform the business in a timely manner, but also to be able to identify how these changes may affect the company’s activities. This requires having a broad vision of the business, knowing it, and understanding it in depth to adequately overcome this type of challenge.

AI has been taken seriously as a potentially revolutionary technological change in the legal world for a number of years now. Has it had a meaningful impact in how your legal team works in this time?

The irruption of artificial intelligence in all areas of business is something that legal management cannot be oblivious to. I am convinced that the emergence of this new technology will bring with it the need to transform the way in-house lawyers carry out our work, forcing us to focus on those tasks or activities where we can add strategic value to the business. In this sense, I do not see artificial intelligence as a threat, but as an opportunity to dedicate more time to tasks that provide greater value to our internal clients.

Based on your experiences in the past year, are there any trends in the legal or business world that you are keeping an eye on that you think other in-house lawyers should be mindful of? 

Without a doubt, I believe that the digital regulatory ecosystem that is being formed in Chile is the biggest challenge we will face from a legal point of view. The entry into force of the new personal data law, the implementation of the open finance system and the new challenges presented by the cybersecurity framework law present challenges that will stress the organisation from every point of view in its implementation stages.

In this sense, in-house lawyers must be able to develop new skills that allow them to interact more closely with the technology and data teams of their companies to ensure an adequate understanding and cohesion between the requirements of these standards and the smooth running of the business.
