What are the key trends that in-house counsel should be monitoring in 2026?

Key trends that in-house counsel should be monitoring in 2026 include developments in Euro mortgage loans, which may follow a similar trajectory to Swiss Franc loans. The direction of changes in the draft bill on foreign exchange mortgage-related proceedings currently under discussion by lawmakers poses an additional risk to banks.

Another area of concern is unauthorised payment transactions. The approach the Consumer Protection Office is seeking to take regarding banks’ responsibilities could increase exposure to fraudulent activities and create potentially unlimited risk for banks.

Finally, it is likely that in 2026 the Consumer Protection Office will conclude the proceedings opened against all retail banks in Poland concerning the so-called modification clauses.

Have you had any experiences during your career as a lawyer that stand out as particularly unique or interesting?

Yes, I have. Together with our sponsor, Greenberg, we completed a unique and innovative M&A transaction – the sale of the retail division of DB Poland to Santander – where the operational merger became effective on the demerger date.

What do you think are the most important attributes for a modern in-house counsel to possess?

Strong business acumen and a commercial mindset; excellent risk judgment; acting as a strategic business partner rather than merely a legal technician.
