What are the most significant cases or transactions that your legal team has recently been involved in?

Our team has been involved in a broad range of strategic matters, including capital markets transactions (both equity and debt), delistings of affiliated companies, capital increases, M&A transactions, and the implementation of artificial intelligence within civil litigation workflows. These initiatives reflect both the scale and diversity of the legal function’s contribution to the business, spanning transactional, advisory, and operational innovation.

What new pressures are you facing from the business as expectations for legal to act as a strategic partner continue to grow?

The legal function has evolved into a fully-fledged business unit within the organisation, managing one of its largest budgets. As a result, there is increasing pressure not only to provide legal support but also to actively contribute to business performance.

One of the company’s primary strategic objectives is to reduce the volume of new claims, which represents a significant challenge. Achieving this requires deeper and more integrated collaboration with other business areas. In this context, data management has become critical, alongside the development of loss projections and the provision of continuous, structured feedback to operational teams. The role of legal is therefore no longer reactive but increasingly predictive and strategic, relying heavily on data-driven insights to influence decision-making and improve outcomes across the organisation.

How is your organisation adapting to the rapid evolution of data protection, AI governance and cybersecurity requirements in Brazil?

The company has been continuously enhancing its data governance and AI frameworks, recognising cybersecurity and data protection as critical priorities. This is particularly important given our presence in the banking sector, where we handle sensitive personal data on a daily basis.

Efforts are focused on strengthening governance structures, ensuring compliance with applicable regulations, and aligning with best practices in both AI oversight and data protection. This ongoing evolution reflects the need to maintain robust safeguards while supporting innovation and operational efficiency in a highly regulated environment.

What strategies has your legal team adopted to manage disputes and mitigate risks in Brazil’s dynamic business environment?

We have incorporated artificial intelligence into high-volume civil litigation to increase efficiency, agility, and accuracy in our defence strategies. AI also enables more precise data management, ensuring that insights and feedback are shared more promptly with other business units, which in turn supports preventive action and continuous improvement.

In addition, we have implemented tools to identify and address abusive litigation practices, including claims driven by bad-faith actors or unlawful tactics—an issue that represents a significant portion of mass litigation in Brazil. By tackling these practices proactively, we are able to better control exposure and improve the overall quality of dispute management.

These combined initiatives reflect a broader shift towards a more strategic, data-driven, and technology-enabled legal function, capable of responding effectively to the complexities of Brazil’s business environment.
