How do you approach managing legal aspects during periods of instability or crises, and how does your legal strategy align with the broader business strategy to ensure the organisation’s resilience?
As Legal Counsel and Compliance Officer of a private debt fund, my role during periods of instability is to balance speed with discipline. While the business side often faces pressure to act quickly, I focus on providing efficient, practical solutions without compromising compliance or governance. For me, every crisis is not only a challenge but also an opportunity to refine our frameworks and make the fund more resilient for future challenges. I see the legal function as a strategic partner, translating complex risks into clear guidance so leadership can act decisively while protecting long-term value, investor confidence, and reputation. Legal strategy, in my view, should not be a barrier but an enabler that allows an organization to remain resilient and continue growing.
What are the major cases or transactions you have been involved in recently?
On June 25, the U.S. Treasury’s Financial Crimes Enforcement Network (FinCEN) identified three Mexico-based financial institutions—including one that acted as trustee for our investment trusts—as primary money laundering concerns, forcing an immediate and complex fiduciary substitution across our entire portfolio. I played a key role in this process, ensuring timely execution without disrupting operations or investments, and protecting both compliance and stability. Coincidentally, at that critical moment, I’d just obtained my Compliance Officer certification from the CNBV, a milestone that broadened my scope from purely legal to legal and compliance and uniquely positioned me to navigate this regulatory crisis with agility and impact.
How do you prioritise diversity and inclusion within your legal department, and what initiatives have you implemented to foster a more inclusive and equitable work environment?
For me, diversity and inclusion are guiding principles in the way I lead and practice law. At my current fund, I have advocated for balance and flexibility, with women now holding 50% of leadership roles. Earlier in my career at Creel, García-Cuéllar, Aiza y Enríquez, S.C., I served on the Diversity and Inclusion Committee, where I supported initiatives such as extending paternity leave. I have also participated in Mujeres en Finanzas, Mujeres Invirtiendo, and spoken on panels addressing work-life balance and gender equality. As both a lawyer and a mother of two, I see mentorship as a responsibility and am committed to supporting younger women and opening doors for their growth, believing that diverse teams drive fairness, innovation, and more sustainable results.
Which legal tech organisations or products are helping you in your role?
We partnered with Starlight to develop a customized legal ChatGPT for our fund. By uploading our entire loan portfolio into the platform, we can instantly review any clause across contracts in an efficient, accurate, and fully tailored way. This innovation facilitates processes and frees the legal team to focus on high-value strategic work.
