Career Biography

Jorge is a lawyer from Pontifical Catholic University of Chile, and holds a Master of Laws (LL.M.) from the University of Notre Dame Law School in the United States, where he focused on business, regulation, and international dispute resolution. He has complemented his legal education with a Financial Compliance and Analysis course at the International Monetary Fund and a Business & Leadership program in China, enhancing his ability to lead legal teams and support high-impact decisions in global environments.

Jorge Arab is a highly qualified and experienced lawyer with extensive expertise as General Counsel, currently serving as Senior Legal Counsel and Head of Legal for Sungrow Power Supply in Latin America, the Caribbean, and Mexico. He is based in Chile, where Sungrow’s regional most relevant subsidiary is located. With more than a decade of professional experience, he has led critical legal operations in the renewable energy industry, ensuring robust legal structures and enabling the execution of major infrastructure and energy projects across the region.

At Sungrow, Jorge is responsible for all legal and compliance matters in Latin America, including contract negotiation and structuring, regulatory analysis, project development, legal risk mitigation, and internal governance. He serves as the principal legal advisor to senior leadership, supporting key business initiatives and ensuring alignment with legal and regulatory frameworks. Under his leadership, Sungrow’s legal department has achieved high visibility and credibility in the Latin American energy market.

Among his most significant achievements is the successful negotiation and execution of over 10 GWh in battery energy storage system (BESS) contracts, as well as multiple long-term service agreements (LTSA) with major clients. He has also played a decisive role in resolving high-stakes contractual disputes and preventing arbitration or litigation, consistently safeguarding the company’s legal and commercial interests. As Compliance Officer, Jorge has implemented and overseen internal control procedures and programs aligned with anti-bribery regulations, data privacy standards, and international compliance benchmarks.

Before joining Sungrow, Jorge built a strong professional foundation through roles in top-tier law firms and leading renewable energy companies. His practice encompassed energy law, project finance, EPC contracts, corporate regulatory advice, and international dispute resolution. This multidisciplinary experience has equipped him with the tools to manage legal complexity in fast-paced, cross-border environments.

Jorge’s contributions have been recognized both externally and within his organisation. He was named In-House Rising Star at the 2024 Chile Awards and has been listed for three consecutive years (2023, 2024, and 2025) in the GC Powerlist Chile by Legal 500, recognising his leadership and impact as one of the country’s most respected General Counsel. Internally, he has received several corporate distinctions, including the President Award (2025) and the Annual Excellent Individual Award, underscoring his commitment to legal excellence and cross-functional collaboration.

What are the most significant cases, projects and/or transactions that you and/or your legal team have recently been involved in?
Over the past years, I have led the negotiation and execution of landmark transactions that have consolidated Sungrow’s leadership in Chile’s renewable energy market. Notable matters include significant BESS projects with ENGIE (Libélula 1,024 MWh, Coya 638 MWh, Tamaya 418 MWh, among others), ATLAS Renewable Energy (Del Desierto 880 MWh, Estepa 188 MW/4h), and Zelestra (Aurora 935 MWh). I also negotiated the EPC and LTSA for the Dune Plus Project (Generadora Metropolitana / 2 GWh). In total, Sungrow has signed over 8 GWh in BESS contracts in Chile under my legal leadership. These transactions involved complex risk analysis and tailored contractual frameworks. Sungrow Chile and Colombia operate today without litigation or claims, reflecting my consistent focus on preventive legal counsel, compliance, and dispute avoidance.

How do you approach managing legal aspects during periods of instability or crisis to ensure the organisation’s resilience?
My approach focuses on delivering forward-looking legal advice that identifies and mitigates external risks affecting the business. I closely monitor international developments such as tariffs, protectionist measures, and supply chain constraints, ensuring that contractual structures anticipate these exposures. I work with senior management to implement safeguards that protect the company’s operations, contractual certainty, and financial resilience, allowing Sungrow to navigate global challenges with confidence.

What strategies do you employ to ensure the successful digital transformation of a legal department while maintaining compliance with your country’s data protection law?
Digital transformation is not simply about adopting tools, but also about strengthening legal rigor and responsiveness. As Senior Legal Counsel, I focus on embedding automation in key legal processes — particularly contract review and compliance tracking — while ensuring that all systems align with Chilean data protection standards and international best practices. I oversee the legal review of platforms used for storing and processing sensitive information and advise on policies for records retention, cybersecurity, and cross-border data flows. This ensures that our digital transformation enhances both efficiency and legal integrity.

Given the current geopolitical shifts and growing uncertainties around international free trade, has your company’s risk profile evolved, and are you taking measures to address these challenges?
Yes. I have proactively adapted Sungrow’s contractual frameworks to address supply chain volatility, changes in tariffs and duties, and international regulatory risks. I ensure precise allocation of tax and logistics responsibilities, update force majeure clauses, and advise on regulatory developments that could impact the importation of key components. This has allowed Sungrow to maintain robust legal positions and operational resilience amid global uncertainties.

Based on your experiences in the past year, are there any trends in the legal or business world that you are keeping an eye on that you think other in-house lawyers should be mindful of?
A key trend is the rising complexity of contracting for renewable energy projects in Chile, with greater regulatory scrutiny and sophisticated tender requirements that now integrate ESG, local content rules, and sustainability benchmarks. Another critical development is the increasing interplay between data protection obligations and operational contracts, requiring in-house counsel to anticipate contractual implications beyond mere compliance. Lastly, there is a growing expectation that in-house lawyers act as strategic business partners, proactively contributing to the organisation’s competitive positioning.
