What are the most significant cases, projects and/or transactions that you and/or your legal team have recently been involved in?
One of the most relevant projects that my team and I recently carried out is the implementation of the data protection law, which in the case of Ecuador is a recent law. This process mainly included the study of the issued regulations, the survey and analysis of all the company processes that handle personal information, the implementation of policies, adjustments to legal documents, controls, and monitoring.
How do you approach managing legal aspects during periods of instability or crisis to ensure the organisation’s resilience?
In periods of instability or crisis, we manage the legal aspects with a thorough analysis of causes, effects, risks, contingencies, and in this way we prepare an adequate plan to face them, which must have a comprehensive scope and consider all the implications in the organisation’s processes; additionally, committees are activated or created to be able to make decisions with all the areas involved.
How can general counsel foster a corporate culture that supports ESG principles and compliance across all levels of the organisation?
In my case, I have also had the opportunity to lead the ESG area in the company, so this dual role has allowed me to have a dual focus on business development. To ensure that an ESG culture is implemented and promoted, we have provided training at all levels of the organisation, while making sure that the head of the organisation and the first line are part of the strategies and actions, and drive their execution by conveying that commitment and awareness at all levels.
