What are the most significant cases, projects and/or transactions that you and/or your legal team have recently been involved in?
The team has faced major challenges in recent years. One of the most significant projects has been PEC I and PEC II, a mechanism designed to address the freezing of electricity rates in 2019, followed by the contractual consequences of the pandemic, which imposed a series of movement restrictions. Despite this, all power generation plants continued to operate. In 2024, the company participated in the National Energy Commission’s 2023/01 tender for regulated customers, in which the company was awarded the entire amount of energy tendered. Finally, in 2025, the team had to address all the effects related to the February 2025 blackout, an electrical failure of which we had no recent experience, nor of equal magnitude.
AI has been taken seriously as a potentially revolutionary technological change in the legal world for a number of years now. Has it had a meaningful impact in how your legal team works in this time?
AI is a relevant tool in the development of legal work. It can be a great support, but at the same time it must be complemented by a keen sense of criticism and meticulousness on the part of lawyers seeking solutions based on technology. Such tools will certainly become more sophisticated, and this will necessarily lead to higher levels of demand from users.
How does your team contribute to the overall business strategy of the company? Can you share an example of a recent legal-led initiative that had a significant impact?
The legal team assists the business in correctly identifying risks and defining the main legal strategies to mitigate or assume them in the most appropriate manner, enabling the company to achieve successful development.
Looking forward, what trends do you foresee in the legal landscape over the next 5–10 years that companies should prepare for?
The development of the energy business presents many regulatory challenges, local and international economic contingencies, environmental and health issues, and climate change. This means that legal advice must often adapt to situations beyond our control and planning, and adjust to such circumstances while ensuring compliance with the relevant regulations. The coming years will undoubtedly have the same characteristics, requiring innovative solutions and preparation for all aspects involved in the use of new technologies and the protection of the company. We believe that we have faced significant legal situations associated with a pandemic, drought conditions, and complex social and economic circumstances, among others, so the team has experience in dealing with similar challenges.
