How do you approach managing legal aspects during periods of instability or crisis to ensure the organisation’s resilience?
It’s crucial that we do not just view things from own perspective, but rather, we must also think like the opposing side. By doing so, we can identify the best possible approaches for our cases. Moreover, selecting the right law firm is important. We need to ensure that the firm we choose has the expertise and suitability for each specific case we handle. This strategic selection will significantly enhance our chances of success.
What do you think are the most important attributes for a modern in-house counsel to possess?
Many people might assume that in-house counsel only play a passive role, simply responding to queries or fulfilling request from the business units. However, this perception doesn’t capture the full potential of what in-house counsel can contribute. In reality, in-house counsel can take on a much dynamic and influential role within the company, By thoroughly understanding the business and its goals, in-house counsel can proactively provide legal advice and suggest various options that align with legal requirements. This proactive approach ensures that business operations can proceed smoothly without running afoul of the law. For instance, instead of waiting for legal issues to arise, in-house counsel can anticipate potential challenges and advise on the best legal strategies to mitigate risks. They can also work closely with business units to develop innovative solutions that comply with regulations while still achieving business objectives. By being more involved and proactive, in-house counsels not only protect the company from legal pitfalls but also add significant value by guiding the business towards sustainable and legally sound growth.
Based on your experiences in the past year, are there any trends in the legal or business world that you are keeping an eye on that you think other in-house lawyers should be mindful of?
The rapid evolving world of Artificial Intelligence (AI) and the current absence of specific laws governing its use are the topic that drawn my attention. As we continue to integrate AI into various aspects of our operations, it is crucial to consider how we manage and utilize data to stay compliant with future legislation. One of the primary concerns is the extent to which we can use data without infringing upon future laws. This includes safeguarding trade secrets, managing personal data responsibly, and establishing internal policies that align with the increasing use of AI. As we navigate this dynamic landscape, it is essential to remain vigilant and proactive in our approach to AI governance and data management.
