How do you approach managing legal aspects during periods of instability or crises, and how does your legal strategy align with the broader business strategy to ensure the organisation’s resilience?

Proactive legal–tax analysis is a differentiator; a robust preliminary analysis allows us to make decisions about potential risks from the outset. Our processes are increasingly comprehensive and aim to ensure that, in the event of a tax audit, we already know our analysed risks and even how they have impacted our financial statements.

What measures has your company taken to embed sustainability practices into its core business operations, and how does the role of the general counsel contribute to driving and ensuring sustainable practices within the company?

We have implemented processes that ensure we can conduct a legal and tax analysis of new businesses or verticals, enabling us to be a true partner that supports the business and provides assurance that a new process will not generate risks of non-compliance. We have seen that new businesses can be detrimental if they create a tax contingency.

More than 25 years of experience in law firms, government, and currently in the largest private company in Mexico.

At the moment, I serve as In-House Counsel for Mexico, Central America, and Chile, responsible for identifying potential tax risks and ensuring compliance through audits of the entire Group before federal and local tax authorities, from completion to the implementation of proactive or reactive measures. I am responsible for developing strategies regarding proactive and reactive administrative and judicial defences.

I also act as an internal consultant for all business areas and verticals of the Group on legal and tax matters, manage the processing and obtaining of indirect tax refunds in Mexico, and oversee the documentation and control of all potential risk positions across all Group companies.
