How do you approach managing legal aspects during periods of instability or crises, and how does your legal strategy align with the broader business strategy to ensure the organisation’s resilience?
Based on our experiences during these difficult times, we have come to the conclusion that teamwork is the fundamental foundation for facing any period of crisis or instability. This requires strong and ongoing communication and support within the team (we are talking about our legal department) as well as interrelation and communication with other areas of the Company. Contingency plans can be created to deal with periods of crisis, but if people are not trained and identified with the team, these plans can remain only theoretical.
It is a latent reality that in our Latin American countries, political, social, and economic instability are ever-present, and it is something we constantly have to deal with. Perhaps this daily lesson has taught us in a practical way to always have a Plan B for any project, venture, or business execution, since we never know if the conditions we started with will endure over time.
Having a cohesive team that follows a common goal fulfills the objective of supporting the Company in facing periods of crisis and instability.
What are the main cases or transactions that you have been involved in recently?
In June and July of this year, he was involved in the negotiation and execution of a recovery process in favor of the Company, which had been ongoing for more than two years. We hired a law firm in Costa Rica to assist us with legal recovery actions against a client who obtained surety bonds in Bolivia, but whose main office is located in Costa Rica. Earlier this month, we obtained a court ruling setting a hearing. We wanted to use this hearing to reach an agreement or negotiate a payment in order to continue a long and costly trial for both parties. Unfortunately, the hearing was postponed until September. We hope that a conciliation can be achieved, which is beneficial for both parties.
What do you see as the major legal challenges for businesses in Bolivia over the next five years, and how are you preparing to address them?
Given the speed at which our society is transforming with the help of technological tools, including and especially artificial intelligence, I believe that one of the main challenges in our area, and one that contributes to the Company’s business plan, is to stay aligned with these technological advances, stay up-to-date, and use these technological tools to our advantage.
Thus, the Company, and specifically our legal area, in coordination with the systems area, is in the development phase of new products to automate contract preparation in the surety bond policy sector. With the creation of a module in this area that serves to prepare standard contract templates—currently in operation with self-liquidating guarantees—we are now moving forward with guarantees granted under a line of credit. This means that, in the policy issuance process carried out by the commercial area, it will be able to simultaneously issue the policy, and the counter-guarantee contract to deliver both to the client (insured), saving time and resources.
