About

Fabio Bertoni is the general counsel of The New Yorker, where he has served since 2014. In this role, he oversees all legal matters related to the magazine’s acclaimed journalism, including pre-publication review of articles, videos, podcasts, and other multimedia content. Fabio works closely with award-winning editors, reporters, and fact-checkers to navigate complex legal issues surrounding newsgathering, publication, and intellectual property.

Bertoni’s work has been integral to The New Yorker’s most high-profile and impactful journalism of the last decade, including Ronan Farrow’s Pulitzer Prize-winning investigations into Harvey Weinstein, Patrick Radden-Keefe’s reporting on the opioid epidemic and Purdue Pharma, and Jane Mayer’s investigations into dark money in politics. He’s also served as counsel on Oscar-nominated documentaries and fiction films, and numerous National Magazine ward-winning stories and series. In addition, he supervises litigation across U.S. and foreign jurisdictions, including in India, Italy, Turkey, and France, and appears in both state and federal court on behalf of the magazine.

Bertoni also supervises legal affairs for The New Yorker’s expanding audio and podcast programming, including launching The New Yorker Radio Hour, a nationally syndicated show in partnership with WNYC, and In the Dark, an investigative series.

Prior to joining The New Yorker, Fabio served as assistant general counsel at HarperCollins Publishers, where he advised the Children’s Division on contract, copyright, and trademark matters and vetted non-fiction books by Amanda Knox, Dwyane Wade, and others. From 2006 to 2012, he was vice-president and deputy general counsel at ALM Media, overseeing legal matters for over 30 publications, including The American Lawyer and The New York Law Journal.

Bertoni began his career as an associate at Hughes Hubbard & Reed LLP and Squadron, Ellenoff, Plesent & Sheinfeld, LLP, where he focused on media, copyright, and First Amendment law, defending major publishers, broadcasters, and film studios.

Bertoni has also taught Media Law Drafting at Fordham Law School and Publishing & Internet Law at NYU’s School of Professional Studies. He is a frequent speaker nationally and internationally on media and press freedom issues, including at the International Journalism Festival in Perugia, Italy; the World Law Congress in New York, and the Media Law Resource Center’s conferences in Virginia and London.

Bertoni also writes on legal and first amendment issues, and hason The New Yorker’s He holds a J.D. from Columbia Law School, an M.S. from Columbia Graduate School of Journalism, and a B.A. in English from Hunter College.

Bertoni occasionally writes on legal issues for The New Yorker website, publishing pieces on the Supreme Court’s first amendment rulings, the Gawker v. Hulk Hogan case, and other matters. He has appeared on the HBO series Catch and Kill: The Podcast Tapes, and on WNYC’s The Brian Lehrer Show and numerous podcasts. He currently serves on the Board of Trustees of the Scoville Memorial Library in Salisbury, CT, and on the Hunter College Pre-law Advisory Board.
