Position

Peter is a Senior Associate in the litigation department at Carson McDowell LLP and works within the commercial litigation and dispute resolution teams. Peter has extensive experience of advising and acting in company, shareholder and partnership disputes to include minority shareholder petitions, breach of directors’ duties actions and partnership dissolution actions. Peter’s breadth of experience also includes defending and prosecuting intellectual property actions in the High Court in Northern Ireland to include a number of high value and complex patent infringement cases for clients in the technology and manufacturing sectors; advising and acting in copyright and trademark infringement matters, and further misappropriation and misuse of confidential information actions which have necessitated applications for injunctive relief to include mandatory injunctions and search and seizure orders. Peter also has experience of advising in complex contractual disputes relating to supply and manufacturing defect issues and has defended a number of Commercial Agency Regulations claims brought by agents. In addition, Peter has successfully prosecuted a judicial review action on behalf of interested parties against a Health Trust in respect of the failure to properly consult on the proposed closure of a hospital facility.

Carson McDowell¬†has a solid track record assisting technology companies, public sector bodies, retail companies and telecoms providers with regulatory matters, transactions and disputes, and has seen an uptick in instructions from start-ups. The group is advising Innovation Ulster, the technology company owned by Ulster University, on its investment in NeuroCONCISE Medical‚Äôs brain computer interface invention, a wearable neurotechnology that interprets brainwaves and translates them into control signals so the wearer can interact with computers without moving; the invention is aimed at helping people with brain injuries. Other clients include Go Testify and AMMI Systems. The ‚Äėapproachable and knowledgeable‚Äô Dawn McKnight¬†leads the team and is well known for her expertise in tech-related mandates. Peter Guzhar¬†made partner in May 2017.

Carson McDowell’s IP expertise ranges from M&A-related IP work to patent agreements, infringements, licensing rights, software protection and ownership management. The group’s client base includes IT and technology companies, healthcare entities, educational bodies, energy companies, infrastructure providers and retailers. The team is advising Independent News and Media on expanding its trade mark portfolio by registering new marks to protect its existing brands as part of its IP activities in Northern Ireland. Other highlights included assisting biopharmaceutical company SiSaf with entering into a patent and know-how licence agreement with another biopharmaceutical entity for developing plaque psoriasis treatment drugs through using SiSaf’s IPR. The firm also acts for US technology company Xilinx, the University of Ulster, and Firmus Energy. Dawn McKnight  leads the team, which also includes Declan Magee and Peter Guzhar, who are well known for acting on contentious IP mandates. Consultant Eileen Moughan left the firm in December 2017.

  • THE VAT E-COMMERCE PACKAGE

    A. INTRODUCTION   The VAT E-commerce Package adopted by the Council on the 5th of December 2017 includes several changes that will be gradually implemented, some changes will be effective as from the 1st of January 2019 and the rest as from the 1st of January 2021.
  • Doing business in Ukraine: turning point for the currency control in Ukraine

    One of the most hotly discussed topics in 2019 is currency control liberalization in Ukraine.The currency control liberalization was one of Ukraine‚Äôs priorities under the EU-Ukraine Association Agreement. At the beginning of 2019 the National Bank of Ukraine (hereinafter the ‚ÄúNBU‚ÄĚ) approved and promulgated all long-awaited regulations, serving as the basis for a new liberal¬†system of foreign currency control. The new¬†currency control¬†system will be launched on 7 February 2019, the same day as the Law of Ukraine¬† On Currency and Exchange Transactions¬† becomes applicable. The changes are aimed at deregulation, facilitating cross-border transactions with foreign currency and expanding the list of available foreign currency transactions.
  • New Long Term Residency Visas

    After much media coverage, Cabinet Decision 56 of 2018 (the Decision ) has been gazetted which introduces new long term residency visas to, amongst others, four categories of persons in the UAE. 
  • Significant Changes to Civil Procedure Code

    Significant changes to Federal Law No 11 of 1992 (the Civil Procedure Code ) will soon be coming into effect. These changes are introduced through regulations (the Regulations ) issued under the Civil Procedure Code and will come into effect on 16 February 2019.
  • Merger Clearance Matters

    The United Arab Emirates (the UAE ) promulgated legislation to specifically address the regulation of competition (being Federal Law 4 of 2012, or the Competition Law ) several years ago but until recently, it has been the case that the requisite implementing regulations and processes were not in place. This is no longer the case. Not only have the much anticipated implementing regulations been issued, the UAE Ministry of Economy (the Ministry ) (being the regulator in charge of administering the UAE competition regime) has now formed the required committee and issued the anticipated guidance and forms to allow concerned parties to make merger clearance submissions to the Ministry where required to do so pursuant to the Competition Law.
