Real estate dispute resolution (property litigation).


Tina is head of the real estate dispute resolution group. Specialist areas include commercial and residential landlord and tenant advice. She is a member of the Property Litigation Association, as well as being a member of the ALEP (the Association of Leasehold Enfranchisement Practitioners) and has lectured and represented seminars on the enfranchisement legislation. Tina has conducted a huge number of complex enfranchisement cases, including claims against the grosvenor estate. She handles both commercial and residential lease renewals, complex disputes and advises clients on a range of policy and strategy issues. She has responsibility for managing a number of key client relationships, including: Dorrington Plc, the Royal Borough of Kensington and Chelsea TMO, Lloyds Bank and the London Borough of Enfield.

DMH Stallard LLP fields a substantial team from its various offices in the region and counts builders and developers, investors and banks among its clients. The team's recent work includes advising Chartwell Land & New Homes on the acquisition of land for development, which included the negotiation of options and resolving various title issues. It is also acting for a number of corporate and individual landowners on a large mixed-use commercial and residential development that could provide up to 500 homes and which involves complex contractual and planning issues. Key senior members of the team include practice head Tina George, Nick Pentecost, who heads the real estate development team, Cathy Searle who is based in the Guildford office, Anne Milne, whose work includes various real estate-related financing,  Charles Pfister and Ben Price.

DMH Stallard LLP's property litigation team has firmly established itself as 'a leading player in the South East and more than able to compete with London outfits'. The practice has a deep and varied arsenal of property litigation specialists, with notable expertise in business ratings cases and property-related professional negligence cases.In an illustration of its track record in business ratings, cases, the practice acted for Cardtronics Europe before the Court of Appeal in an appeal against a determination that external facing ATMs should be separately assessed for business rates purposes from the premises in which they are situated. The practice also acted for the freehold owner of an industrial estate in potential remedies against the waste occupier of part of the site following the occupier's prosecution by the Environment Agency after it was found to be operating in breach of planning requirements. Emily Wood heads the property litigation practice, which was further strengthened by the merger in 2017 with Rawlison Butler, which brought on the 'brilliant' Vanessa Joll, who is 'extremely client focused, easy to work with and hugely effective'. Other key figures include real estate head Tina George, who has particular strength in collective enfranchisement cases; and senior associate Kristine Ng, who is 'a star in the making'.

DMH Stallard LLP's social housing practice has established 'a well-deserved reputation for quality of service and approachability'. Its expertise spans the full spectrum of housing management services, from possession claims and anti-social behaviour matters, to disrepair claims and public law and policy advice. It also provides acquisition, regeneration and development advice to clients including registered providers and local authorities. Emily Wood acted for a local authority client in a claim for possession of a three-bedroom house following the death of the tenant, but which was occupied by the tenant's daughter and her adult son. Other key mandates included acting for Orbit Group on the acquisition of the affordable housing element on a mixed joint venture scheme, and acting for Golding Homes on the acquisition and construction of affordable housing dwellings as part of a larger housing development site. Tina George is also recommended.
