Position

Robert specialises in patent litigation. He has a PhD in molecular biology and is particularly active for clients within the life sciences sector. Many of the patent and SPC cases he has handled have required the coordination of proceedings in the UK, EPO and other jurisdictions within Europe and beyond. He therefore has in-depth knowledge of European litigation and, alongside appearing for clients in the High Court and Court of Appeal, has attended preliminary injunction and main action proceedings in multiple countries within Europe and overseen inspections of pharmaceutical manufacturing processes in India and Japan. One of his recent cases involved an enquiry into the damages payable under a cross-undertaking provided in respect of an interim injunction and was only the second case of its kind in the UK. Robert also advises clients on other IP rights and is one of a small number of lawyers with expertise on plant variety rights. In addition to his litigation experience, Robert assists clients with freedom to operate opinions and due diligence on the intellectual property aspects of commercial transactions. Robert regularly advises clients on the status and strategic implications of the UPC and, more recently, the impact of Brexit.

The 'excellent' and 'client-focused' Bristows LLP has a strong reputation in patent litigation, but also works on matters involving transactions, regulations and competition. The practice is headed by patent litigator Liz Cohen and transactions specialist Laura Anderson. Brian Cordery is head of patent litigation and very active in this space. He was instructed by Teva in patent revocation proceedings brought by Eli Lilly relating to humanised antibodies, which may be used for a landmark treatment of migraines. Other important  contentious IP specialists include Edward Nodder, Robert Burrows and Dominic Adair. Burrows defended Janssen Sciences and G.D. Searle against a revocation brought by Sandoz and Hexal relating to darunavir, which is a key ingredient in Janssen's anti-HIV drug Prezista. Also recommended are corporate specialist Marek Petecki, who assisted AstraZeneca with its $300m sale of the European commercial rights to its Seloken heart medication to Recordati, and senior associate Rachel Mumby, who focuses on patent litigation.
