On 14 December 2017, Anastasia Cheredova, associate of VEGAS LEX Commercial group, spoke at the Fifth All-Russian Congress “Pharmaceutical activity in Russia and in EEU: Winter 2017 statutory regulation” organised by the Agency for Social and Economic Development with support of the State Duma of the Federal Assembly of the Russian Federation, Ministry of Economic Development of the Russian Federation, Ministry of Health of the Russian Federation and other ministries and industry-specific agencies.
On 14 December 2017, Anastasia Cheredova, associate of VEGAS LEX Commercial group, spoke at the All-Russian Conference “Drug provision and drug price control. Importation and protection of intellectual property rights to medicinal products (MPs). Government procurements and marking” that took place within the framework of the Fifth All-Russian Congress “Pharmaceutical activity in Russia and in EEU: Winter 2017 statutory regulation” in Moscow.
Anastasia told about the most significant trends in development of the law enforcement practice of government procurements of pharmaceutical drugs (PDs) in 2017, having touched upon the issues of substitution and the most recent judicial practice of delineation of powers in this field. The expert further drew attention to the latest legislative changes, specifically, the adoption of new rules concerning the description of a subject-matter of procurement, which may result in the substantive change of approaches of antimonopoly authorities and courts as early as 2018. Another issue, which was discussed within the scope of the speech, has become a new procedure for calculating the initial maximum contract price (IMCP) upon procurements of PDs as well as the prospects of use of the new rules. In conclusion, Anastasia reminded of the status and discussed initiatives for restricting involvement in government procurements.
The legislation in the area of turnover of drugs between the EEU’s countries in 2018, the procedure for undergoing and confirming the state registration of medicinal products in Russia and in EEU in 2017-2018, the pilot project for marking pharmaceutical drugs, the matters of state control of prices for pharmaceutical drugs and medical products, the protection of intellectual property rights and antimonopoly regulation on pharmaceutical market in Russia and in EEU, the specifics of importation of medicinal products and active pharmaceutical ingredients into the Russian Federation and other issues were also discussed at the congress.
