VEGAS LEX held in Moscow a workshop on the matters related to the trends and problems of practical application of bankruptcy legislation for employees of Inter RAO Group.

On 12-13 December 2017 VEGAS LEX experts held the seminar “Bankruptcy: novelties and trends” for Inter RAO Group in Moscow.

Alexander Vyazovik, VEGAS LEX Partner and Manager of Bankruptcy projects, told about the main strategies of creditors and debtors in bankruptcy proceedings, and schemes of asset stripping and dilution of list of creditors applied by unscrupulous debtors, and methods for combating them. The expert described the most effective tools that creditors could use for this purpose. Particularly, Alexander dwelt on the matter of the reasons for inefficiency of rehabilitation procedures envisaged by current legislation and shared opinion on advantages and disadvantages of the draft law on introduction of debt restructuring as supplementary rehabilitation procedure that is under consideration of the State Duma of the Russian Federation.

Evgeniy Rodin, VEGAS LEX Partner and Head of Energy practice, provided the case studies of involvement in the cases of bankruptcy of natural monopoly entities.

Victor Petrov, VEGAS LEX Head of Litigation practice, and Stanislav Matyushov, associate, analysed in detail the constituent elements of the crimes usually revealed in bankruptcy and the principal conditions for holding the guilty persons liable.

In special session of the workshop, Anna Evdokimova, associate of Bankruptcy projects, told about peculiarities of challenging the debtor’s transactions under the rules of the Law “On insolvency (bankruptcy)” and trends in judicial practice concerning such disputes.

Rustem Miftakhutdinov, Associate Professor of the Department of Entrepreneurial and Corporate Law of Kutafin Moscow State Law University (MGUA), retired judge of the Supreme Arbitration Court of the Russian Federation, made a speech at the workshop as invited guest. His speech was about the application of the newly adopted rules of imposition of secondary liability on the debtor’s controlling persons.
