Firms To Watch: Dispute resolution: litigation

RRG Abogados ‘ compact litigation team is led by experienced partner Stefanie Ramdohr , who specialises in civil liability lawsuits involving the electricity, construction, engineering and healthcare sectors, and insurance claims.
Originally established in 2017 as Darraidou, Silva & Donoso Abogados before rebranding as Donoso & Silva Abogados, the dispute resolution practice at this specialist boutique is co-led by Rodrigo Donoso, whose broad experience covers ADR, arbitration and litigation; and former Barros & Errázuriz associate Bruno Romo, who focuses on civil and commercial litigation.
With a strong orientation towards the disputes sector where it handles contentious commercial, construction, concession, infrastructure and energy and mining matters, along with shareholder disputes, mid-2021 start up, FIX Abogados brings together corporate and real estate specialist Clemente Silva (formerly a senior associate at Morales & Besa) with disputes specialists Nicolás Zisis (formerly a senior associate at Bofill Mir Alvarez Jana Abogados), Vicente Portales and Gerardo Otero (both formerly at Claro & Cia.) and Tania Villarroel, who has an additional public policy aspect to her disputes practice.
Launched in 2021, natural resources, energy and environmental boutique IMAD Abogados recruited civil and commercial litigation specialist Claudio Matute in early 2022 from Urzúa | Matute Abogados (where he was name partner), to head-up the firm’s dispute resolution practice.
Founded in 2017, Lembeye Abogados ‘ litigation team -which is active in disputes involving construction contracts, energy projects and public works concessions- is co-led by experienced partner Daniel Praetorius , an expert in civil and criminal litigation, and administrative sanction proceedings; and senior associate Orlando Palominos , an arbitration, litigation and insolvency specialist who arrived from Morales & Besa in January 2022.
Specialised in civil, criminal, and administrative litigation, QRF Abogados (Quintana Ried Flores) was launched in early 2019 by former Bofill Mir & Álvarez Jana (BMAJ) partner Rodrigo Quintana, and Ignacio Ried and Camila Flores (both previously senior associates at BMAJ).

Dispute resolution: litigation in Chile

Bofill Escobar Silva Abogados

Specialist dispute resolution firm Bofill Escobar Silva Abogados houses a sizeable 22-strong team that focuses exclusively on the resolution of complex or cross-border business disputes – frequently with a high profile or of a politically sensitive nature. The practice has experienced notable growth, recently, in litigation before and against public entities (such as the Ministry of Public Works, the Comptroller General, National Economic Prosecutor and the Municipality of Las Condes), in relation to urban developments, infrastructure, antitrust matters and environmental law. The group is jointly led by Jorge Bofill , one of Chile’s most renowned litigators, particularly for white-collar matters; Francisco Aninat , who ‘attends to the needs of clients in a timely and accurate manner‘; and complex disputes and cross-border litigation specialist Sebastián Yanine . Vanessa Facuse , a former litigation division chief at the National Economic Prosecutor, is also highly regarded, as is of counsel Marcela Vega , who acts in commercial, civil, criminal and labour cases, as well as administrative matters concerning public institutions. Notable internal growth includes the elevation of criminal litigation expert César Ramos  (a hire as director from Albagli Zaliasnik in early 2021) to partner in January 2022.

Practice head(s):

Jorge Bofill; Francisco Aninat; Sebastián Yanine

A committed and cohesive team that is professional and technically impeccable – it is capable of providing great legal advice and representation, working together with the client, while strategically addressing the different issues. The partners also work very well with the firm’s associates in their delivery of an excellent service.

The partners are directly committed to the needs of their clients – they provide comprehensive advice, respond in a timely manner, and show a unique concern for the client.

The firm recently focused on deepening its expertise in new conflicts, including areas such as digital technology, movement of international capital and environmental conflicts. Its combination of extensive litigation experience in a wide variety of highly public cases with solid training and constant assessment of future trends means it stands out from the competition.

A well-known firm in Chile, with great professional successes and excellent professionals.

Its partners, led by Jorge Bofill, are among the most relevant lawyers in Chile and are constantly sought out by the press and large corporations for comments and analysis.

I would highlight Jorge Bofill and Sebastián Yanine – great lawyers, great prestige, aggressive as litigants, and highly successful.

Vergara Labarca Parodi

A boutique trial firm that is dedicated to its cases’, the former Vergara, Labarca & Cía reincorporated as Vergara Labarca Parodi in mid-2022, with Alejandro Parodi -‘definitely one of the best trial lawyers in Chile’– becoming a name partner. The 10-member team handles disputes involving commercial and civil law, construction, antitrust, energy and finance, as well as stock markets, shareholder conflicts, mining, environmental law and regulatory matters, with clients noting ‘they assume fewer cases in order to dedicate themselves to each one of them’. The practice is led by deeply experienced founding partner Raimundo Labarca, who has a 30-year track-record in contentious matters and is a specialist in civil, commercial, constitutional and administrative disputes. The aforementioned Parodi handles complex litigation and arbitration – again, as regards civil, commercial, constitutional and administrative matters; and José Manuel Concha acts in civil, commercial and real estate-related disputes, particularly those related to the design, construction and operation of complex engineering projects. At associate level, Raimundo Diego Labarca‘s experience also includes construction-related claims, along with tort law cases, shareholder disputes and breaches of contract. The team was strengthened with the December 2021 hires of Jaime Ríos Llaneza and María de los Ángeles Lecaros – both handle civil and commercial litigation and arbitration.

Practice head(s):

Raimundo Labarca

Vergara y Labarca is a very good law firm, they are very efficient in their processes as well as meticulous in reviewing everything that must be presented in a trial. It compares favourably with other firms, ranking, in my opinion, at the first level for litigation in Chile. In my case, I worked with José Miguel Concha, a lawyer with an excellent manner, which allowed a fluid work process to obtain the best result to contribute to the trial, in my case the preparation of three legal opinions.

They are specialists in their subject. They also differ in that they take on fewer cases in order to grant greater dedication to each one of them. All team members are excellent.

All its members have been in the studio for some time, which makes them know each other well and complement each other as a team.

Professional excellence.

‘Vergara Labarca is the best litigation team in Chile. Its members are very experienced, methodical and creative. In my opinion they are above the other litigation studies. Only Pedro Pablo Gutierrez and Cristóbal Eyzaguirre are comparable.

They stand out for their knowledge, their rigour, their creativity and their ability to plan a litigation that involves and dismantles the strategies of their rivals. The ability of Raimundo Labarca to plan strategies; the knowledge and creativity of Alejandro Parodi; and the rigor and method of José Manuel Concha. They work with their clients, actively involving them, to achieve the best presentation of the facts in order to win litigation.’

Given the pandemic in Chile and the world, the team remained active, seeking solutions to court closures, and advancing a legal strategy that was tremendously successful.

Alexander Parodi is definitely one of the best trial lawyers in Chile and at the same time close and empathetic.

It is a boutique trial firm with great dedication to the causes and special attention to detail. They take care not to leave loose ends and to cover all scenarios and possibilities. They are always on top of their causes, their presentations are solid and consistent, the team is highly specialised and trained.

Raimundo Labarca and José Manuel Concha are two outstanding partners in their practice. They have an excellent relationship with clients and counterparties. Both are very prepared and know very well how the courts operate, develop the best strategies and at the same time make a realistic analysis of the client’s position and possibilities. They are great negotiators, but can also sustain difficult litigation with warring parties.

A tremendous litigation team.

The team recently announced that it will form its own boutique dispute resolution office, led by Andrés Jana. I have no doubt that it will do very well – they are great lawyers.

The strong point is the great commitment to clients, and the creativity with which the lawyers approach all issues. I have been amazed at the depth of the analysis, and how quickly the team goes through all the details of each case.

An excellent dispute resolution group that is led by partners Andrés Jana and Karen Werner. Both are excellent trial attorneys and possess technical skills that set them apart from other firms in this area.

Karen Werner stands out for her intelligence, professionalism, dedication and care taken during every case in which she is in charge. The result obtained was excellent and working with her was a pleasure.

A very orderly, methodical and diligent team. As clients, we feel very comfortable with its work.

Correa Squella provided us with dynamic and clear advice even in the middle of the Covid-19 emergency. The lawyers successfully assisted us with a highly complex litigation case – a compact group that is able to analyse multiple options so as to implement the right course of action – definitely one of the best firms in Chile.

Juan Ignacio Correa and Jorge Sepúlveda are very professional, creative and available to their clients.

Their attorneys are very well prepared in civil and regulatory issues. Our main contact is Jorge Sepúlveda, who has solid legal and litigation skills. Jorge provides a first-class service – I like his global vision of problems and his ability to strategise.

Coz & Blavi

Established as Coz & Jofré in 2020 by José Coz and Álvaro Jofré (both formerly of Oddo & Cía), this specialist dispute resolution subsequently re-branded as Coz Jofré & Blavi Abogados, further to the incorporation of Francisco Blavi (from Pellegrini & Cía), later the same year, since when the firm has consolidated its market position. Complex litigation specialist Blavi also acts in domestic and international arbitrations involving the construction, energy and finance and corporate sectors; Jofré’s disputes experience ranges across construction, agriculture, mining and regulated markets-related work, along with disputes involving high-profile individuals and families’ interests in companies; and Coz is a litigation and arbitration expert, with a growing reputation for both strategy and procedural matters. However, associate Benjamín Letelier  moved to Schenke Brancoli Abogados in June 2022.

Practice head(s):

Francisco Blavi; José Coz; Alvaro Jofré

Assertive and strong strategy from the beginning that left the start of the litigation on a good footing.

Clear, concise and direct presentations that allow the transmission of the main elements of the strategy and evidence, while maintaining the interest and attention of the parties and the judge.

High-level oral presentations from great procedural strategists, which is hard to find in large corporate firms – true involvement of the partners in the work of the case and its details and strategy, which is often lost in the large firms.

We entrust the most complex litigation cases to the team and its lawyers always obtain the best results. Their understanding of the complexities of our business is immediate and the ability to achieve judicial results impeccable.

The main thing is the creativity and depth with which they face and solve cases, either from a legal point of view or from a negotiation standpoint. I would also highlight the commitment and availability of the partners to get personally and directly involved in each action carried out.

Legal knowledge and the ability to understand business and the clients’ realities, and creativity in dealing with cases – a great team.

José Coz and Alvaro Jofré really complement each other, which allows them to provide an excellent service.

Personalised attention from Francisco Blavi – he is 100% personally involved and gives all his energy to cases.

The core team comprises Gonzalo Nieto, a projects-related disputes expert; Pauline Chiffelle, who undertakes environmental, electricity, civil, commercial, and competition-related litigation; and dispute resolution, litigation and antitrust specialist Santiago Ried. Practice head(s):

An exceptionally professional and prepared team. Dentons is one of the offices against which I have had to litigate, where the lawyers do not leave details to chance, and each of their presentations is precise and complete.

The team of lawyers have shown their absolute knowledge and mastery of our matters. Excellent responses and collaboration.

High-quality advice and the fees are reasonable. Compared to other firms on the market, I find the work of the Dentons’ litigation practice to be the best value for money.

Dentons has diligently dealt with the different disputes that have arisen with my business. I want to highlight the commitment and professionalism of the lawyers. Regardless of the amount or nature of the conflict, they are always concerned with finding prudent and beneficial solutions.

Its strength is that it has young and committed partners, and when a new dispute arises, the firm forms interdisciplinary teams with other areas of the office, generating a comprehensive approach to the conflict.

The Dentons litigation team provides outstanding advice on both the merits of a dispute and aspects of the judicial process. The lawyers correctly anticipate the movements of the other party and the judicial decisions of the courts. Compared to other firms, I believe that they are far superior when it comes to satisfying the expectations between what is demanded and what the courts will finally grant.

The lawyers against whom I have had to litigate are Santiago Ried and Marcelo Alarcón. I only have good words for them, both in form and substance. Regarding the former, he was open to negotiate and his conduct was proper throughout the procedure. Regarding the latter, I want to emphasise that during each appearance, his preparation and knowledge were solid.

Marcelo Alarcón has been outstanding in his advice, both in response times and in their quality. He is a committed and willing lawyer. No matter how many emails or messages are sent to Marcelo, he always answers each and every one of my questions very quickly, and with complete, prudent and assertive answers.

The lawyers have also managed remote technologies perfectly.

A multidisciplinary team, which provides comprehensive advice.

Extensive experience in litigation, but the most remarkable thing is that despite this, the fees are reasonable. It is a very good option for first-class legal services at a reasonable price.

I would say that the main quality is the confidence the lawyers project.

I have a very good impression of the team, which currently represents our company in a highly complex litigation, and its advice has always been very complete – great connectivity too, which allows it to be attentive to our requirements.

Always available and with great capacity to adapt to different challenges.

Reliable, honest, transparent and highly professional. Capable of handling all types of cases, regardless of their complexity. I want especially to mention José Alberto Allende, who has helped me with several highly complex cases, where we have always obtained good results.

Excellent litigator José Alberto Allende has great legal knowledge and is a great strategist, which always gives us peace of mind to make decisions. He transmits serenity and confidence, which allows us to evaluate our scenarios correctly. The rest of the team is young, dynamic and always available.

José Alberto Allende is an exceptional lawyer, whose advice is always complemented with a business vision, which makes it very comfortable to work with him. In addition, I constantly receive various emails with updated information on the status of my cases.

The lawyers always respond very quickly to my requirements and queries, with solid and informed responses – great for the personalised, partner-level attention, availability, dedication, clarity and intelligent strategies.

They work as a team, demonstrating coordination and the professional dedication of each practice member.

‘An active, creative legal team that has vast knowledge of the technical areas involved in litigation – great learning ability, cordial, diligent and continuous 24/7 availability.

Ability to integrate the team with client executives and internal staff in a collaborative, participatory and creative manner – extraordinary ability to act quickly in the event of legal emergencies.

Disputes are addressed in a realistic manner, with strategies taken in conjunction with clients and without creating false expectations.

Direct contact with clients and professionalism when dealing with litigation, as well as clarity when explaining the strategies and steps to follow.

Efficient and timely attention, and I would highlight the expertise of partners Joaquín Montero and Viviana Brito C, who have personally handled my lawsuits.
