Matthew Maddison appeared in Re: Arlington Infrastructure Limited, involving a challenge to the validity of an out-of-court appointment of administrators, as well as determining whether a qualifying floating charge may be rendered “unenforceable” under Paragraph 16 of Schedule B1, which requires the charge to be enforceable before an administrator can be appointed. The 'confident' Kelly Bond appeared for the successful trustees in Re Lasytsya, a bankruptcy case where a bankrupt's attempt to set aside a search and seizure order made under section 365 of the Insolvency Act 1986 was dismissed. The case involved issues of implementing appropriate safeguards when drafting the mentioned orders at a without notice hearing, and the requirement for full and frank disclosure on applications made without notice.
