Dentons Link Legal successfully represented Hindustan Zinc before Rajasthan High Court in a petition filed by Hindustan Zinc against an order of Rajasthan Electricity Regulatory Commission burdening consumers of the state of Rajasthan with a cost of around INR 8 thousand crores.
The Firm had advised the Client to approach High Court than availing statutory remedy route of APTEL on the ground of violation of natural justice. Further, it had advised the Client to restrict prayer to certain portion of the burden (around INR 5 thousand crores out of INR 8 thousand crores). The High Court was pleased to grant relief in terms of such prayer sought.
This case is the first case in judicial history of India, wherein, a High Court has set aside Fuel Surcharge Adjustment imposed on the ground of prolonged litigation.
The Judgment is beneficial not only for consumers but also for generators because they will be paid their dues within time to avoid any adverse consequences.
