Matouk Bassiouny & Hennawy (“MBH”) is proud to announce a significant achievement by its Litigation team, which successfully secured a landmark victory in a complex cross-border criminal dispute involving assets valued at over EGP 1 billion.
MBH represented one of Lebanon’s prominent families in a multi-jurisdictional matter arising from a series of fraudulent transactions targeting substantial landholdings located in Egypt. Investigations revealed a sophisticated scheme involving the forgery of multiple powers of attorney, which were unlawfully utilized to facilitate the transfer and disposition of key real estate assets belonging to the family.
MBH was retained at a critical stage of the matter, as the defendants had approached the competent Survey Authority seeking to collect compensation related to the family’s property using the forged powers of attorney.
MBH’s team successfully managed to secure compensation with an excess amount of EGP 43 million due to our client and promptly reported the fraudulent usage of the forged powers of attorney to the competent authorities. Following extensive investigations, the Public Prosecution referred the defendants, along with the forged powers of attorney, to the competent Felony Criminal Court on charges related to the forgery and use of forged official documents.
Over the course of the proceedings, MBH led all aspects of the case before the Criminal Court, including the preparation of comprehensive legal memoranda, the development of robust legal arguments supported by extensive documentary evidence, and the submission of detailed rebuttals to the arguments advanced by the defense team and foreign witness testimony presented throughout the court hearings.
In a decisive outcome, the Felony Criminal Court convicted the defendants with ten years of rigorous imprisonment for forging official documents and using forged official documents.
This landmark judgment highlights MBH’s ability to navigate complex, high-stakes criminal disputes spanning multiple jurisdictions. It represents an additional significant victory for the client, safeguarding substantial assets and reinforcing the rule of law against sophisticated fraudulent schemes.
