Recently, De Penning & De Penning successfully assisted a Japanese multinational company in a major crackdown of counterfeit products in relation to bicycle components in Mathura, Uttar Pradesh.
During the raid and investigation huge stocks of counterfeit products were seized and the counterfeiters were also arrested in the raid action.
Prior to the initiation of the raid action, the Firm outlined the following:
- Checked the recurrence of activities across India and located the exact source of the counterfeiter to have an impactful raid action;
- Made test purchases of counterfeit products;
- Sought a side by side comparison of the original and counterfeit product from its client to assist the enforcement authorities;
- Trained its investigation wing members on the differences for a seamless raid action.
The aforementioned due diligence certainly assisted in a successful raid action and the Firm was able to register a First Information Report under the relevant provisions of the Copyright Act, 1957 and the Trade Marks Act, 1999.
