DSK Legal represented and appeared for Korean producer/ exporters POSCO group and DCM Ltd. before the Directorate General of Trade Remedies (‘DGTR’) in the anti-dumping investigation concerning imports of Electrogalvanized (‘EG’) Steel originating in or exported from Korea RP, Japan and Singapore.

An application was filed by M/s American Precoat Speciality Private Limited (‘Domestic Industry/ DI’) before the DGTR, seeking initiation of the extant anti-dumping investigation, wherein it was alleged that dumped imports of EG Steel from the subject countries were causing material retardation to the establishment of the DI. The DGTR initiated the investigation to determine the existence, degree, and effect of the alleged dumping of EG Steel from the subject countries into India.

Counsels from the Firm filed exporter questionnaire responses, written submissions and appeared and presented arguments on behalf of the clients before the Authority.  Basis such representations, the DGTR was pleased to record a negative dumping margin and accordingly recommend a ‘NIL’ rate of duty for POSCO group. The representations also ensured that the entirety of exports from DCM Ltd. is excluded from the scope of the product under investigation, as these were not ‘like products’.

The above result implies that POSCO group and DCM Corporation continue to enjoy full market access in India for EG Steel, as their exports will not attract anti-dumping duty.
