Posse Herrera Ruiz fields a specialised, six-strong team with a proven track record in areas such as merger control, antitrust investigations/litigation, consumer protection, regulatory compliance and data protection. ‘Excellent lawyerJaime Herrera and the ‘experiencedDaniel Posse lead the team. Posse, with the support of associates Juan Pablo Bonilla and Hernán Panesso, is representing Scribe in relation to price-fixing investigations by the SIC; after an initial fine amounting to $4m, the client received total immunity due to its collaboration with the authorities in dismantling the cartel. A team led by Herrera advised Coca-Cola FEMSA on merger control clearance for its acquisition of the AdeS soy-beverage business from Unilever. Other clients include Diageo Colombia, Cencosud and Automotores Toyota Colombia.

Oscar Tutasaura is assisting Fairfax Financial Holding on the $250m acquisition of insurance provider AIG Colombia; Jaime Herrera acted for FEMSA Logística on its acquisition of an 80% interest in Operaciones Nacionales de Mercado-OPEN MARKET, a high-profile corporation in Colombia’s logistics market; and José Alejandro Torres advised Grupo Sura on its $538m acquisition of a 7.3% stake in Sura Asset Management from General Atlantic. Other clients include Delta, Diageo, COPEC and AON. Jaime Cubillos, Gabriel Sánchez, Vivianne Baptiste and Lina Prieto are also noted for their expertise.

Posse Herrera Ruiz works for local and international sponsors and lenders, with a focus on sectors such as infrastructure, transportation, power, hydrocarbons and telecoms. It has vast experience in PPPs, bidding procedures and financings, and has been very active in major 4G concession projects. It is currently advising a client on its potential application as a bidder for the Ciudad CAN project, for the construction, operation and maintenance of three public buildings which will house government offices. Practice head Alessia Abello is leading advice to Conconcreto on its $1.3bn project to construct a third lane for the Bogotá-Girardot highway section; the work has included assisting in the submission of a private non-solicited offer with no public funds which was approved by the National Agency of Infrastructure (ANI). Other clients include CODAD, Macquarie and Vinci Concessions. José Alejandro Torres, Jaime Herrera and Álvaro José Rodríguez are all active members of the practice, with associates Paola Aldana and Sebastián Lora also noted for their work.
