We advise the client on an ongoing basis regarding insurance issues for the structuring of its service providing contracts.

Also, we have advised them concerning a dispute with ABB in Norway for the supply of a transformer that was faulty.

AON RISK SERVICES

We advised AON Risk Services on regulatory matters and viability of a contract for the acquisition of an interest in Synergyas, a company that groups insurance brokers.

DRUMMOND LIMITED

PHR represents Drummond as a Defendant in a tort proceeding. Plaintiffs allege damage to their property due to a fire allegedly caused by Defendants’ Negligence.

SBS Seguros Colombia is involved in the proceeding as the Defendants’ Insurance Company.

ODINSA VÍAS, CONCAY, INFERCAL ET AL.

Consortium Grupo Constructor Autopistas del Café, integrated by Odinsa Vías, Concay, Infercal and other individuals and companies, as EPC Contractor for the Autopistas del Café Road concession, subcontracted with the Consortium Novum – Osorio the construction of a connector between two road.

Subcontractor terminated the contract before completion of the works, alleging economic imbalance.

Pursuant to the contract, the Subcontractor obtained an insurance policy, issued by Compañía Mundial de Seguros, to guarantee the performance of its obligations.

In April 2022, Consortium Novum – Osorio filed a claim against our client, alleging breach of contract.

We filed a counterclaim for the portion of the advance payment that was not amortized, and the recovery of payments made by our clients to employees and suppliers of the Consortium Novum – Osorio.

We also called Compañía Mundial de Seguros to be part of the proceeding, claiming the payment of the insurance policy.

Mundial argued that our clients, not being the policyholders, did not have standing to call it to the arbitration.

The Tribunal dismissed the argument.

 

TAKAMI S.A.

Posse Herrera Ruiz represents Takami in a tort proceeding against Icono Urbano S.A., Acción Sociedad Fiduciaria S.A. and Allianz Seguros S.A.

The Plaintiff alleges that the Defendants damaged its property due to the construction of a large building next to the Plaintiff´s property in the city of Bogotá D.C.

The Plaintiff seeks the payment of damages derived from loss of profits.
