Mark Ter Molen is a litigator, with a particular emphasis on product liability/mass tort and environmental matters, and environmental attorney who for more than 20 years has focused primarily on representing clients in federal and state product liability/toxic tort and environmental trials and appeals, including putative class actions, in complex products and environmental litigation, and in regulatory hearings and appeals conducted before state and federal agencies. He also provides general corporate counselling on environmental compliance issues and environmental concerns in the context of corporate transactions; supervises environmental remediations pursuant to various state and/or federal requirements; and conducts condemnation and property valuation actions. Mark is the co-chair of Mayer Brown’s Environmental Litigation group, which was recently named by Law 360 as one of the “Environmental Litigation Groups of the year” for 2011. Mark is also the former chair of Mayer Brown’s mass tort litigation group. Among other accolades, Mark has been selected as a Leading Lawyer in Environmental Law and Toxic Tort Defense Law by the Law Bulletin Publishing Company's Leading Lawyers Network; as an Illinois "Super Lawyer;" and is listed in Chambers USA’s “America's Leading Lawyers for Business” directory, the Legal 500 for litigation, and various other allegedly prestigious lawyer rating services. In 1996, Mark was honored with the Illinois State Bar Association’s John C. McAndrews Pro Bono Service Award for outstanding pro bono work in the state.

Mayer Brown’s ‘highly intellectual’ team provides ‘great counseling on strategy and risk management’ on high-stakes cases involving torts relating to greenhouse-gas emissions, site-based mass tort claims, issues of first impression under CWA, challenges to EPA regulations under CAA, criminal environmental prosecutions, renewable energy projects, and complex environmental cleanup projects involving the application of remediation technologies. Examples include its continued representation of several industry groups in litigation attempting to prevent the enactment of certain regulations contained within the CWA, and representing Weyerhaeuser Corporation before the Supreme Court in a case brought by the Fish and Wildlife Service under ESA alleging 1,500 acres of private timberland as critical habitat for the dusky gopher frog; the ‘fabulousTimothy Bishop leads both cases from Chicago. He is ‘the name to call if you have environmental litigation before the Supreme Court’.
