Head of property finance as a team within the banking and finance department, acting both for borrower and lender in property-related loan facilities, syndications, restructuring and refinance as well as traditional banking transactions. Headline transactions include the restructuring of syndicated property-based loan facilities with aggregate value of c¬£400m (client undisclosed) and advising on Northern Irish elements of pre-IPO finance for a major international company with value of approximately ‚ā¨800m.


Qualified in Eversheds commercial property team in 2003 and remained with Eversheds until 2007 predominantly advising corporate occupiers and investors, institutional lenders and funds in relation to property finance and restructuring matters. Returned to Northern Ireland in 2007 joining Carson McDowell as an assistant solicitor, being promoted to associate in 2009 and to partner and head of restructuring and insolvency team in 2012. Remained in that position until move to Tughans as partner and head of property finance team in January 2015.

Tughans‚Äô finance team provides a ‚Äėvery good level of service‚Äô to banks, corporates and investment firms on restructurings, property development, acquisitions and project finance, among other areas. Highlights included acting as Northern Ireland counsel to Delamare Cards MTN Issuer regarding¬†the ¬£1.4bn issuance of notes backed by Visa and MasterCard credit card receivables originated by Tesco Personal Finance PLC; advising Investec Bank on a ¬£27m financing to a South African investment company to purchase a Tesco Superstore in Newry; and acting as Northern Ireland counsel to NewDay inits ¬£295m issuance of consumer credit-backed securities. Other clients include Bank of America Merrill Lynch, which the firm represented in its purchase of the Jurys Inn Group, and the Bank of Ireland, which the firm advised on providing increased loan facilities to a leading telecoms provider for the purpose of restructuring the group. Fearghal O'Loan¬†jointly leads the practice with David McAleese, who is well known for his expertise in property and restructuring mandates.

  • Doing business in Ukraine: turning point for the currency control in Ukraine

    One of the most hotly discussed topics in 2019 is currency control liberalization in Ukraine.The currency control liberalization was one of Ukraine‚Äôs priorities under the EU-Ukraine Association Agreement. At the beginning of 2019 the National Bank of Ukraine (hereinafter the ‚ÄúNBU‚ÄĚ) approved and promulgated all long-awaited regulations, serving as the basis for a new liberal¬†system of foreign currency control. The new¬†currency control¬†system will be launched on 7 February 2019, the same day as the Law of Ukraine¬† On Currency and Exchange Transactions¬† becomes applicable. The changes are aimed at deregulation, facilitating cross-border transactions with foreign currency and expanding the list of available foreign currency transactions.
  • New Long Term Residency Visas

    After much media coverage, Cabinet Decision 56 of 2018 (the Decision ) has been gazetted which introduces new long term residency visas to, amongst others, four categories of persons in the UAE. 
  • Significant Changes to Civil Procedure Code

    Significant changes to Federal Law No 11 of 1992 (the Civil Procedure Code ) will soon be coming into effect. These changes are introduced through regulations (the Regulations ) issued under the Civil Procedure Code and will come into effect on 16 February 2019.
  • Merger Clearance Matters

    The United Arab Emirates (the UAE ) promulgated legislation to specifically address the regulation of competition (being Federal Law 4 of 2012, or the Competition Law ) several years ago but until recently, it has been the case that the requisite implementing regulations and processes were not in place. This is no longer the case. Not only have the much anticipated implementing regulations been issued, the UAE Ministry of Economy (the Ministry ) (being the regulator in charge of administering the UAE competition regime) has now formed the required committee and issued the anticipated guidance and forms to allow concerned parties to make merger clearance submissions to the Ministry where required to do so pursuant to the Competition Law.
