Pedro Garcia is a recognized practitioner in the areas of contracts and corporate law, regulatory and antitrust, with significant experience in the mining and infrastructure sectors. Pedro is the Firm’s regional coordinator for the Mining Practice Group in Rio de Janeiro. He brings extensive knowledge to client projects, providing expert counsel on local and cross-border transactions, negotiating and drafting of commercial agreements, antitrust proceedings, and regulatory, real estate and environmental issues for mining ventures. Mr. Garcia is also a member of the Board of Directors of the World Initiative of Mining Lawyers – WIOML.
Mining clients frequently retain Mr. Garcia to advise them on a variety of areas specific to the industry, including the structuring of new investments in mining projects, purchase and sale transactions for exploration and exploitation tenements, and due diligences before the National Department of Mineral Production (DNPM). Clients also rely upon his counsel in drafting option and lease agreements, farm-in/farm-outs, streaming and royalty contracts. Mr. Garcia has also advised clients on mergers and acquisitions, financing of mining ventures, ore purchase and sale agreements, environmental issues, surface rights arrangements and service agreements.
From the antitrust perspective, Mr. Garcia’s experience includes handling antitrust proceedings across multiple industries, including mining, oil & gas, infrastructure and finance. He is well versed in the analysis of potentially anti-competitive agreements and submission for approval of proposed mergers and acquisitions before the Administrative Council of Economic Defense (CADE). Mr. Garcia also focuses on the negotiation of terms of performance commitment and economic restrictions with the antitrust authorities, anti-competitive practice proceedings and compliance programs.
Mr. Garcia brings a unique global perspective to clients gained from his experience working and studying abroad. He spent two years in Europe working as a foreign attorney with Simmons & Simmons in their London and Lisbon offices, where he focused his practice on corporate law, capital markets and antitrust law. During this time Mr. Garcia also took post-graduate courses at the University of Lisbon and University of London. Fluent in Spanish, Mr. Garcia is deeply involved with the Latin Desk of Veirano Advogados.
