Stuart Pearson
Work Department
Construction, Energy & Projects
Position
Stuart is a Partner in our Construction, Energy and Projects team. He undertakes contentious and non-contentious construction, infrastructure, energy and major projects, from procurement to completion for public and private bodies.
Stuart was promoted to Partner in November 2019. He acts for national and local government, private sector developers, contractors, design consultants and financial institutions.
He has advised on bespoke and standard-form construction contracts for routine projects, through to £multi-billion financed schemes from procurement to completion. His work ranges from drafting and negotiating sector specific agreements (including bespoke and standard form contracts, e.g. JCT and NEC) for road projects; to catering and facilities management contracts, resolving contractual disputes including issues relating to step-in rights, measured term contracts and final accounts.
Stuart has specialist PPP expertise including a working understanding of the Mutual Investment Model. He gave evidence to the Welsh Government in relation to matters affecting the construction industry in Wales and was invited to contribute to its inquiries into the state of the roads in Wales and capital funding sources (both of which centred around the use of MIM).
Stuart regularly delivers external training on a variety of topics and has had a number of articles published in sector focused publications – most recently discussing the future of our cities in view of the growth of innovative transport firms and an in-depth look at Smart Cities.

(Next Generation Partners)Under the leadership of Stuart Pearson, Capital Law Limited has developed a particularly strong reputation advising on major Welsh infrastructure and energy projects. In this regard, Pearson is particularly effective at advising public sector clients, including the Welsh government, by dint of his market-leading knowledge of projects utilising the Mutual Investment Model (MIM). Pearson also handles contentious matters, as does senior associate Sam O’Callaghan, who adds particular benefit to clients by dint of his qualifications as a trained barrister. On the private sector front, the team regularly works alongside the commercial property team for developers.
Wales > Private client > Charities and not-for-profit
Although the team was weakened by the recent departures of both Trish D’Souza and Nicola Mead-Batten to Blake Morgan LLP and TLT, respectively, Capital Law Limited still maintains a not insignificant presence in the charities/not-for-profit sector. A significant amount of this work relates to employment advice to healthcare clients, with senior associate Jonathan Walsh regularly acting for core firmwide client, the British Medical Association, both in terms of individual member disputes but also in respect of national issues affecting the nation’s doctors. Stuart Pearson and Leanne O’Brien also frequently handle construction and real estate-related advice to further education providers.
