Position

Natasha Kapp is a partner in Carey Olsen’s trusts and private wealth group in Guernsey.

Natasha deals with all aspects of contentious and non-contentious trust matters. She advises professional trustees, family offices and ultra high net worth families and individuals on the establishment, administration and restructuring of complex trusts and foundations and underlying structures. She has acted on the establishment of and continues to advise some of the largest family offices and philanthropies established on the Island. Natasha also advises on insurance regulation.

She regularly appears before the Royal Court of Guernsey in trust administration proceedings including applications regarding the interpretation of trust powers, the variation of trusts, the doctrine of mistake, the application of the Rule In Hastings Bass, Beddoe applications, rectification and the blessing of momentous decisions.

Natasha has been listed on the Citywealth Leaders in Private Wealth List since 2014, she has also been recognised in Legal Week’s Private Client Global Elite listings in 2021. She is ranked as a leading individual for Private Client, Trusts and Tax, in Guernsey in the Legal 500, 2019 edition. She is also ranked in the Chambers HNW Guide 2020.

Natasha is a regular contributor to law and industry journals and is the author of the Guernsey chapters in Trusts in Prime Jurisdictions and Private Foundations – A World Review.

Career

Prior to joining Carey Olsen in 2009 Natasha was a partner at Jan S De Villiers (since incorporated with Werksmans) in Cape Town, South Africa. Natasha is qualified as an attorney, notary and conveyancer of the High Court of South Africa and a solicitor of England and Wales (non-practising) and is an Advocate of the Royal Court of Guernsey.

Carey Olsen‘s team supports HNWIs with the setup and restructuring of trusts, private trust companies and family offices, while working alongside the firm’s litigation practice to represent clients engaged in multijurisdictional trust disputes. Practice head Russell Clark handles both contentious and non-contentious trust matters, notably advising on the establishment of complex trust structures. Natasha Kapp‘s practice encompasses both private wealth structuring and philanthropy, as well as contentious trust issues. Having retired from the partnership in June 2022, Konrad Friedlaender continues to advise on a wide range of trust matters in addition to pensions, employee benefit and share option schemes as a consultant.
