Industry focus: Retail Tier 1
Bird & Bird works across the retail sector, with a particular expertise in intellectual property, trade marks and technology. The firm is also active in data protection and privacy-related matters. Corporate and M&A specialist Lourdes Ayala leads the practice with Antonio Cueto, who focuses on intellectual property. The team is advising Bloom Motion on its prospective investment in the Bacoa Group of gourmet burger restaurants, and is assisting Celor SAS with the acquisition of a stake in Clicars Spain, a car retailer. Other clients include Ben Sherman, Aora Health and Associated British Foods.
Bird & Bird was bolstered by the arrival of Mariano Santos, who joined in March 2018 from Herrero & Asociados. Well-regarded of counsel Raul Bercovitz recently advised Lexmark on the impact of the Royal Decree-Law 12/2017, which has established a private copying compensation system based on levies on recording and storage devices. The ‘fast and helpful’ group at Bird & Bird works across the sector including in intellectual property, regulatory and product liability. The firm has particular expertise in litigation relating to pharmaceutical and life science patents. Leading the team is Raquel Ballesteros, who is a litigation and public procurement expert, and Manuel Lobato, who is a specialist in intellectual property and pharmaceutical law. In a recent highlight, the department represented Sanofi Aventis in a special appeal challenging the tender documents called by the health service of Catalonia for the supply of the hexavalent vaccine. The firm also acted for Insud Pharma in litigation relating to the infringement and validity of two patents.
Bird & Bird has expertise in trade mark litigation, trade secrets, design, and unfair competition matters. Mariano Santos is leading the trade mark prosecution strategy for Ben Sherman, and Manuel Lobato is representing Marv Films as the claimant in an infringement action against the use of its mark Kingsman by a Spanish distillery. Antonio Cueto, of counsel Raúl Bercovitz and senior associate José Ángel García-Zapata are also singled out.
Industry focus: TMT Tier 3
‘A strong knowledge’ of the sector allows Bird & Bird ‘to get the best result for clients’. The firm has dedicated sub-groups focusing on technology and communications, as well as data protection, and provides expertise in dispute resolution across all areas. The ‘understanding and available’ team is led by Pablo Berenguer, Alexander Benalal, Lupe Sampedro and senior associate Juan Calderón. The practice is advising Quintiles IMS on its commercial, privacy and data protection issues. In another highlight, the department is assisting Verizon Telematics with matters relating to the integration of Movil Data Internacional, a Spain-based provider of commercial fleet management solutions.
Projects and energy Tier 3
Bird & Bird is particularly active in the renewables sector, focusing on multi-jurisdictional and complex M&A transactions. Energy specialist Hermenegildo Altozano leads the practice with Coral Yáñez, who is an expert litigator with notable experience in regulatory matters, and counsel Borja López, who was a new hire in 2018 from energy assets investment and management company Bow Power. The team assisted Gransolar with the sale of a portfolio comprising 19 photovoltaic plants in Sevilla to Vela Energy. It also advised Gas Natural Fenosa on the sale of 20% of its natural gas distribution and secondary transmission business in Spain to a consortium of Allianz Capital Partners and the Canada Pension Plan Investment Board.
Bird & Bird acts on M&A deals, spin-offs, joint ventures, and corporate and debt restructurings, as well as providing commercial advice. Highlights included assisting Pomona Keepers with the €15m sale, jointly with EII (Ventures), of a majority stake in the share capital of World Bulk Wine Exhibition to Comexposium. Real estate and construction Tier 4
Highlights for the team at Bird & Bird team included advising the Pontegadea Group on the acquisition of 9.99% of Telxius Telecom valued at €378.8m. Isidro Del Moral and counsel Jacobo Sánchez-Andrade are the practice heads.
EU and competition Tier 5
Bird & Bird's work ranges across the competition area and the team benefits from its ability to work closely with the full-service firm’s experts in other sectors. Practice head Patricia Liñán, who joined from CMS Albiñana y Suárez de Lezo in 2017, specialises in antitrust damages claims. Her department is representing Lactalis in its appeal before the Constitutional Court against the dawn raids carried out by the Spanish Competition authority related to its alleged participation in exchanges of information between dairy industries on pricing and commercial strategies. In another highlight, the group is acting for Adveo in the appeal against a fine in connection with the envelopes for exports cartel case.
Banking and finance Tier 6
Bird & Bird has niche expertise in aviation and sport finance. For example, it advised Macquarie Bank on two separate loan facilities granted to Atlético Madrid. The group, which is led by José Luis Lorente, added payment industry expertise with Adrián Calvo joining as senior associate in April 2018 from an in-house position at Visa.
