Mr. Wang specializes in commercial litigation and arbitration, company investment, real estate, construction as well as intellectual property. He has provided professional legal services to over a hundred of large domestic enterprises, government agents and chambers of commerce. Mr. Wang has extensive experience in commercial litigation and arbitration. Many of cases he represented have been selected as typical by The Supreme People’s Court.

Non-Prosecution Project: Construction Engineering and Real Estate:

Listing of Global Logistic Properties Limited on the Singapore Exchange Securities Trading Limited and issuance of US dollar-denominated bonds in Singapore.

The Government of Singapore’s Industrial Investment Corporation (GIC) cooperated with a number of domestic representative real estate development enterprises, including China Resources Land, Vanke, Capital Land and Sunshine Co. in investing in real estate projects in Beijing, Tianjin, Xi’an, Qingdao, Shenyang and other provinces and cities.

Beijing Vanke’s acquisition of Beijing Jindi, a subsidiary of Beijing Sumitomo Corporation

Non-Prosecution Project: Infrastructure & Energy:

Largest infrastructure project for the Longtan hydropower station in China.

Henan Pingdingshan Thermal Power Project.

Shandong Peninsula Wind Power Development Project.

Product Liability Disputes:

Represented Mitsubishi Motors Corporation, Japan, in a Mitsubishi Motors brake products liability case.

Represented Motorola Inc. in the world’s first case of radiation exposure from mobile phones, succeeding in getting the court to accept Motorola’s defense and winning the case.

Represented a leading German chemical company in a product liability dispute, providing advice and solutions in response to the dispute in China.

Construction and Real Estate Disputes:

Acted for Hong Kong Construction (China) Engineering Co., Ltd. in a real estate cooperation dispute in Tianjin High Court and Supreme Court.

Represented a large domestic real estate development company in an arbitration case concerning the joint development of a real estate project (valued at RMB 3 billion) with a Korean company.

As special consultant of Robin Department Store (Chengdu) Co., Ltd, planned and directed the litigation attorneys in handling the dispute concerning the letter of intent on housing sales cooperation with Sichuan Dadi Real Estate Development Co., Ltd.

Corporate & Equity Disputes:

Represented ZTE Corporation/Yangzhou ZTE Mobile Communications Equipment Co., Ltd. in the second trial of a dispute over a sale and purchase contract between it and Beijing Success Communications Electronics Engineering Co., Ltd. The case was hailed by the industry as “the first case to pierce the corporate veil/denial of corporate personality”.

Represented Guangzhou DONGLING International Investment Co., Ltd. in handling a dispute arising from a major asset reorganization with ten shareholders including China Agricultural Production Materials Group Corporation.

Acted for a listed company in a dispute between its shareholders over control of the listed company.

Contract Disputes:

Represented Xinjiang Production and Construction Crops Agricultural Production Material Supply Company in handling disputes over sales contracts with Yunnan Hongxiang Chemical Co., Ltd. and Yunnan Xiangfeng Fertilizer Co., Ltd. in the first instance of the Xinjiang High Court and the second instance of the Supreme People’s Court.

Represented Chongqing Xinlongda Real Estate Shengfa Co., Ltd. in first instance of Chongqing High Court and the second instance of the Supreme People’s Court between it and Chongqing Hongbiao Trading Co., Ltd. and Chongqing Jiefangbei Maoye Department Store Co., Ltd..

Represented Xiaoqing Company in a contract dispute with several accompanying advertising companies.

Valuation Adjustment Mechanism (VAM) Disputes:

Represented Cedar International Trust Company Limited (formerly Zhongjiang International Trust Company Limited) in handling a VAM dispute (the subject matter of the dispute exceeded RMB 5 billion) between the company and Guosheng Financial Holding Group Company Limited.

Representation of a former shareholder of a listed company in an arbitration case concerning a VAM dispute between the former shareholder and a newly introduced one.

Representing the former shareholder of a high-tech enterprise in an arbitration case concerning a VAM dispute between the former shareholder and the newly introduced one.

Patent Infringement Disputes:

Represented Shandong Dongyue Organosilicon Materials Co., Ltd. in handling several patent infringement disputes between it and Jiangxi Spark Organosilicon Factory of Blue Star Chemical New Materials Co. As the defendant’s litigation agent, in this case after jurisdictional objections and trial, successfully made the plaintiff to withdraw the complaint.

As special counsel for ZTE Corporation, provided comprehensive planning solutions for ZTE in the global patent battle with Ericsson and Huawei, and guided the team to participate as litigation attorneys in dozens of overseas and domestic litigation cases.

As special counsel of Shenzhen Longke Technology Co., Ltd. in a dispute with Walt Disney (Shanghai) Co., Ltd. over infringement of patent rights of inventions. The case was awarded “Typical Case of Intellectual Property Dispute” by the Beijing Intellectual Property Court.

Copyright and Trademark Disputes:

Represented CMO Shengjia International Auction Co., Ltd. in handling its dispute with Yang Jikang (Yang Jiang) and Li Guoqiang over copyright infringement and privacy. This case was listed in the “2013 Top Ten Intellectual Property Cases” of the Supreme People’s Court and was awarded “Top Ten Typical Cases of Intellectual Property in Beijing” by the Beijing High Court.

Represented and won a trademark dispute between Computer Family Magazine, People’s Daily and Hong Kong Computer Family Magazine. This was the first case in China involving “a dispute over trademark rights in three places across the Taiwan Strait”.

Counseled Gome Electrical Appliances and Gome Liquor in trademark disputes, planning and executing trademark disputes.

Unfair Competition Disputes:

Represented Degussa (China) Investment Co., Ltd. and Cao Guojun in their dispute with Tianjin AkzoNobel Peroxide Co. Successfully obtained the plaintiff’s withdrawal of the lawsuit as the defendant’s legal representative.

Represented Beijing Qihoo Technology Co., Ltd. in an unfair competition dispute with Baidu.com and Baidu Online Network Technology (Beijing) Co. As a litigation attorney for Qihoo, she obtained a favorable verdict for Qihoo, and the case is known as the “first domestic Robots (search engine) agreement case”.

Represented Beijing Qihoo Technology Co., Ltd. in an unfair competition dispute with Baidu.com Technology Co. As a second instance litigation attorney for Qihoo, he innovatively raised a public interest defense against Qihoo’s conduct, which was accepted by the court. The case, known as the “interpolation case”, was selected as one of the “Top Ten Innovative IP Cases” by the Supreme People’s Court.

Matrimonial and Family Inheritance Disputes:    

Acted for the owner of a large domestic developer in a death and inheritance dispute (worth RMB 20 billion) and tort dispute.

Represented the de facto controller of a listed company in a post-divorce property dispute (worth tens of billions of RMB).

Represented in annulment cases of an international marriage and property disputes after divorce.

 

Administrative Litigation:

Represented the China Securities Regulatory Commission in a case involving administrative inaction on behalf of a shareholder, and won the first and second instance.

On behalf of the Beijing Municipal Development and Reform Commission, responding to the case of administrative inaction in respect of citizens’ highway tolls, winning the first and second instance.

Represented Nantian Electronic Information Industry Group Corporation in handling the demolition and compensation dispute between it and the People’s Government of Panlong District, Kunming, and won the first and second instance.

Academic Activities And Research Achievements:

Mr. Wang has participated in numerous government legislative activities and academic research.

Author of Study on Mechanisms for the Liability of Partners (2006) published in Economic Law Review, introduced the concept of Special Limited Liability Partnership for the first in mainland China.

Author of Conscience of Arbitrators and the Realization of Substantive Fairness in Arbitration Proceedings (2004) published in Beijing Arbitration.

Author of The Legal Liability of Property Management Enterprises Should be Clarified (2002) published in China Property Management.

Mr. Wang sits as arbitrator of China International Economic and Trade Arbitration Committee (CIETAC), arbitrator of Beijing Arbitration Commission and arbitrator of Taiwan Chinese Arbitration Association. He serves as a non-permanent member of Administrative Review Committee of the Beijing Municipal Government. Mr. Wang has been the adjunct professor of Peking University Law School and part-time instructor of China University of Political Science and Law for over ten years.

Mr. Wang has been repeatedly recognized by Chambers and Partners as a leading practitioner in the field of Dispute Resolution: Arbitration; Leading Lawyer in Real Estate and Construction Engineering and Dispute Resolution by Asialaw.
