Partner. Richard is a highly experienced insurance and reinsurance lawyer who has acted on a broad range of insurance claims and non-claims disputes. His specialisms are:
- Cyber insurance, particularly incident response
- Technology errors & omissions claims
- Non-claims advice to insurers’ in-house legal teams, including on reinsurance issues
- Property and PI claims – particularly technology-related
His experience includes:
- Advising on various cyber breach incidents – heading up the team providing RPC’s award-winning cyber breach response service, ReSecure
- Advising on a dispute relating to the recoverability of ICO fines under cyber insurance as a matter of English law
- Advising on various technology-related disputes, ranging from product and software functionality / implementation to liability for cyber breach incidents
- Advising a price comparison company following a malfunction on its website affecting information passed to product providers, including on regulatory aspects regarding customer notification
- Advising a reinsured on the interaction between reinsurance structures in place to protect exposure to high value property catastrophes
- Advising Royal & SunAlliance in relation to the Court of Appeal case of Coles v Hetherton, which concerned the process and principles for recovery of motor repair costs from at fault drivers’ insurers.
