Work Department

Child abuse litigation and clinical negligence.

Position

With 15 years of experience, Luke heads the Birmingham child abuse litigation team at Irwin Mitchell. He is a senior litigator with APIL and the only Midlands lawyer on the panel of the Association of Child Abuse Lawyers. In addition he has been awarded the Birmingham Law Society Solicitor of the Year award. As the first lawyer in the country to recover in excess of £1m for a family in a claim against their local authority, Luke represents individuals involved in highly publicised scandals involving local authorities and young people in their care.

Luke is often asked to comment on current issues in the press, including the impact of the Jimmy Saville scandal with the BBC, Max Clifford’s assets in the Telegraph and a case against Birmingham City Council featured in The Sunday Times. Luke is committed to focussing on client cases, and is known for his sensitive and practical approach to litigation. Working closely with many child abuse experts and charities, he has a solid understanding of the long term impact of child abuse.

Luke also covers a range of medical law work. He deals regularly with cases involving children and mothers injured at birth, as well as many fatal cases, representing family members at coroner’s inquests. Luke has been involved in several recent high profile cases where local mental health trusts have been criticised for failing to protect vulnerable patients, leading to claims under the Human Rights Act, with specific limitations to bring claims within the HRA criteria.
